No.2135 of 2011\n                  ARJUN KUMAR SINHA, SON OF LATE CHANDRIKA PRASAD\n                                             Versus\n                          THE STATE OF BIHAR THROUGH VIG\n                                           -----------\n<\/pre>\n<p>03   26.03.2011               Supplementary affidavit is filed on behalf of the<\/p>\n<p>                    petitioner.\n<\/p>\n<p>                                  Heard learned counsel for the petitioner as well as<\/p>\n<p>                    learned Special Public Prosecutor for Vigilance.<\/p>\n<p>                                  Allegedly, petitioner was caught red handed taking<\/p>\n<p>                    five thousand rupees as bribe for sending the advisory note of the<\/p>\n<p>                    beneficiaries of Indira Awas Yojna to the concerned bank.<\/p>\n<p>                                  The contention of learned counsel for the petitioner<\/p>\n<p>                    is that the petitioner had already sent the aforesaid advisory note<\/p>\n<p>                    to the concerned bank on 23.08.2010 and the cheque in respect of<\/p>\n<p>                    the advisory note had already been prepared by the concerned<\/p>\n<p>                    bank on 04.09.2010 and, therefore, the question of demanding<\/p>\n<p>                    bribe for sending the advisory note does not arise. It is also<\/p>\n<p>                    pointed out by him that the petitioner has been framed by<\/p>\n<p>                    allegation maker at the instance of one Kamal Nath Singh against<\/p>\n<p>                    whom the petitioner had already filed a complain.<\/p>\n<p>                                  On the other hand, learned Special Public<\/p>\n<p>                    Prosecutor appearing for Vigilance points out that prior to<\/p>\n<p>                    institution of the case, the petitioner had been caught in<\/p>\n<p>                    connection with another case in which he was found taking bribe.<\/p>\n<p>                    So, the conduct of the petitioner is not satisfactory. It is also<\/p>\n<p>                    pointed out by him that the bribed amount has been recovered<\/p>\n<p>                    from possession of the petitioner.\n<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>                         Taking into consideration the above stated facts<\/p>\n<p>          and circumstances of the case as well as previous conduct of the<\/p>\n<p>          petitioner, I do not feel it proper to release him on bail.<\/p>\n<p>          Accordingly, his prayer for bail in connection with Vigilance P.S.<\/p>\n<p>          Case No. 66 of 2010 pending in the court of learned Special<\/p>\n<p>          Judge, Vigilance, Muzaffarpur, stands rejected.<\/p>\n<p>                         However, learned trial Judge is directed to<\/p>\n<p>          conclude the trial of the petitioner within nine months from the<\/p>\n<p>          date of receipt of this order and if the trial of the petitioner is not<\/p>\n<p>          concluded within the above stated period, the petitioner may<\/p>\n<p>          renew his prayer for bail.
