Justice ANTONY DOMINIC\n\n Dated :25\/08\/2008\n\n O R D E R\n                        ANTONY DOMINIC, J.\n\n               = = = = = = = = = = = = = = = = =\n               = =W.P.(C) = = = = = = = = = = = =\n                            No. 25376 OF 2008 U\n                    = = =\n\n\n               Dated this the 25th day of August 2008\n\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner is aggrieved by the securitisation proceedings<\/p>\n<p>initiated by the Bank against him.       According to the Standing<\/p>\n<p>Counsel who entered appearance on behalf of the 1st respondent,<\/p>\n<p>they have already obtained an order under Section 14 of the<\/p>\n<p>Securitisation   and   Reconstruction    of Financial   Assets    and<\/p>\n<p>Enforcement of Security Interest Act, 2002 and a Commissioner has<\/p>\n<p>also been appointed.\n<\/p>\n<p>      2. At this stage what is sought for by the petitioner is that he<\/p>\n<p>may be given a chance to approach the respondent Bank seeking<\/p>\n<p>waiver\/reduction in the liability that is now sought to be enforced<\/p>\n<p>against him.\n<\/p>\n<p>      3. Since the liability to the bank is about Rs.5 lakhs as at<\/p>\n<p>present, the request of the counsel for the petitioner to defer<\/p>\n<p>further proceedings unconditionally cannot be granted. Therefore, I<\/p>\n<p>direct that the petitioner shall, within 10 days from today, remit<\/p>\n<p>W.P.(C) No. 25376 OF 2008<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>Rs.1 lakh and subject to such remittance, further proceedings<\/p>\n<p>pursuant to Ext. P1 shall be kept in abeyance. It is also directed<\/p>\n<p>that once remittance is made as above, it will be open to the<\/p>\n<p>petitioner to approach the Asst. General Manager, Zonal Office,<\/p>\n<p>Kottayam of the 1st respondent bank seeking waiver\/reduction of<\/p>\n<p>his liability in which case the same shall be considered and orders<\/p>\n<p>shall be passed.\n<\/p>\n<p>       4.
