Justice K.K.DENESAN\n\n Dated :21\/12\/2006\n\n O R D E R\n                             K.K.DENESAN, J.\n\n                    -----------------------------\n\n                        WP(C)No. 10901 OF 2005\n\n                    -----------------------------\n\n                Dated this the 21st December, 2006.\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      The   petitioner   is   borne   on   the   cadre   of   Deputy<\/p>\n<p>Tahsildar   in   the   Revenue   Department.     He   belongs   to   a<\/p>\n<p>scheduled   caste   community,   and   as   such,   entitled   to   get<\/p>\n<p>exemption   from   test   qualification   as     provided     in     Rule<\/p>\n<p>13A(1)   of   K.S   &amp;   S.S.R.     He   has   sought   for   a   declaration<\/p>\n<p>that   he   is   entitled   to   temporary   exemption   from   passing<\/p>\n<p>criminal   judicial   test   prescribed   in   the   special   rules   for<\/p>\n<p>the Kerala Revenue Service for appointment as Tahsildar and<\/p>\n<p>that   he   is   entitled   to   be   appointed   as   Tahsildar.     He   has<\/p>\n<p>also  sought  for  a  direction  to  respondents  1  and  2  to  hold<\/p>\n<p>the   meeting   of   the   Departmental   Promotion   Committee<\/p>\n<p>forthwith   to   include   his   name   in   the   select   list   and   to<\/p>\n<p>assign   him   appropriate   place   in   the     list   notified   and<\/p>\n<p>published   pursuant   to   the   meeting   of   the   Departmental<\/p>\n<p>Promotion Committee on 30.12.2004.\n<\/p>\n<p>      2.        Shri.   N.Sugathan,   learned   counsel   for   the<\/p>\n<p>petitioner   submits   that   in   the   select   list   notified<\/p>\n<p>pursuant   to   the   meeting   of   the   Departmental   Promotion<\/p>\n<p>Committee   held   on   30.12.2004,   juniors   to   the   petitioner<\/p>\n<p>have  been   included   and   they   have   been   promoted   to   the   post<\/p>\n<p>of   Tahsildar.     Therefore,   the   petitioner   has   prayed   for   a<\/p>\n<p><span class=\"hidden_text\">WPC 10901\/2005                             2<\/span><\/p>\n<p>direction to the respondents to promote him to the cadre of<\/p>\n<p>Tahsildar   with   effect   from   6.4.2005,   the   date   on   which   his<\/p>\n<p>immediate   junior   in   the   category   of   Deputy   Tahsildar   was<\/p>\n<p>promoted.\n<\/p>\n<p>      3. Heard the Govt. Pleader also.  The disputed issue is<\/p>\n<p>whether the test qualification viz., a pass in the criminal<\/p>\n<p>judicial   test   is   a   test   coming   within   the   purview   of   Rule<\/p>\n<p>13A(1) of K.S &amp; S.S.R.  This Court had occasion to consider<\/p>\n<p>the   above   issue   in   Ext.P14   judgment   passed   on   9.10.2006   in<\/p>\n<p>W.P(C)         25902\/2005.          Ext.P14          judgment         strengthens         the<\/p>\n<p>contention   of   the   petitioner.     He   is   entitled   to   get   the<\/p>\n<p>benefit   of   exemption   as   held   in   the   case   of   similarly<\/p>\n<p>situated persons vide Ext.P14 judgment.  It is so declared.\n<\/p>\n<p>      4.  The Departmental Promotion Committee shall hold the<\/p>\n<p>ad hoc meeting as early as possible to consider the fitness<\/p>\n<p>of the petitioner to be included in the select list for the<\/p>\n<p>year   2005   (Ext.P7)   deeming   him   to   be   fully   qualified   and<\/p>\n<p>prepare   the   select   list   within   six   weeks   on   the   petitioner<\/p>\n<p>producing a copy of this judgment.\n<\/p>\n<p>      5.     Counsel   for   the   petitioner   submits   that   there<\/p>\n<p>remains   only   nine   months   for   the   petitioner   to   retire   from<\/p>\n<p>service.     Having   regard   to   that   fact   the   Government   shall<\/p>\n<p>issue,         as         expeditiously         as         possible,          appropriate<\/p>\n<p>notification   based   on   the   select   list   prepared   by   the<\/p>\n<p><span class=\"hidden_text\">WPC 10901\/2005                        3<\/span><\/p>\n<p>Departmental   Promotion   Committee   in   its   ad   hoc   meeting.\n<\/p>\n<p>Needless   to   state   that   depending   on   the   rank   assigned   to<\/p>\n<p>the   petitioner   in   the   select   list   for   the   year   2005,   he<\/p>\n<p>shall   be   granted   promotion   to   the   post   of   Tahsildar   with<\/p>\n<p>effect  from   the   date   his   juniors   were   promoted   to   the   post<\/p>\n<p>of   Tahsildar.     The   above   exercise   shall   be   expedited   and<\/p>\n<p>completed   bearing   in   mind   that   the   petitioner   belongs   to   a<\/p>\n<p>scheduled   caste   community   and   that   he   is   to   retire   from<\/p>\n<p>service   on   superannuation   within   a   short   period.
