Justice V.GIRI\n\n Dated :27\/08\/2009\n\n O R D E R\n                            V.GIRI,J.\n                      -------------------------\n                  W.P ( C) No.22194 of 2009\n                     --------------------------\n               Dated this the 27th August,2009\n\n                       J U D G M E N T\n<\/pre>\n<p>      Petitioner claims to be the beneficiary under a<\/p>\n<p>scheme called &#8216;Mission for Kerala&#8217;s Development and<\/p>\n<p>Poverty Alleviation (vision 2010) Scheme on          value<\/p>\n<p>addition and post harvest Management&#8221; . Under the said<\/p>\n<p>Scheme, he claims to have been allotted with a Elaneer<\/p>\n<p>Parlour Unit and he availed a loan of Rs.50,000\/- from the<\/p>\n<p>State Bank of India. He made an application before the 1st<\/p>\n<p>respondent seeking a license to conduct a Tender Coconut<\/p>\n<p>Parlour Unit. He was then told that by Ext.P1 that he will<\/p>\n<p>have to obtain a No Objection Certificate from the 3rd<\/p>\n<p>respondent, the    Health Officer, Corporation of Kochi.<\/p>\n<p>Petitioner then approached the 2nd respondent, Secretary<\/p>\n<p>of the Corporation who directed the petitioner to obtain a<\/p>\n<p>certificate from the concerned bank stating that the Bank<\/p>\n<p>has   disbursed the amount and certificate from the 4th<\/p>\n<p>respondent Deputy Director of Agriculture, stating that he<\/p>\n<p>is a member of        Special       Employment Generation<\/p>\n<p>W.P ( C) No.22194 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Programme for one lakh youth. He was also asked to give<\/p>\n<p>an undertaking to the effect that the petitioner shall<\/p>\n<p>dispose of the waste arising from the running of coconut<\/p>\n<p>Parlour unit and shall comply with the guidelines framed by<\/p>\n<p>the 2nd respondent Corporation.\n<\/p>\n<p>      2.    Exts.P2 and P3 evidences that such certificates<\/p>\n<p>have been obtained. Ext.P4 is an undertaking given by the<\/p>\n<p>petitioner.    The 3rd respondent then issued NOC as<\/p>\n<p>evidenced by Ext.P5. But the 1st respondent, in spite of all<\/p>\n<p>these, rejected the petitioner&#8217;s application for license as<\/p>\n<p>evidenced by Ext.P6, which has been challenged in the writ<\/p>\n<p>petition.\n<\/p>\n<p>      3.    A counter affidavit has been filed by the 1st<\/p>\n<p>respondent.      Reference is made to Ext. R1(c) resolution<\/p>\n<p>of the Executive Committee.\n<\/p>\n<p>      4.    Heard counsel on both sides. First respondent<\/p>\n<p>has not given any reason for rejecting the petitioner&#8217;s<\/p>\n<p>application for license. It is now agreed that is permission<\/p>\n<p>sought to conduct a mobile Elaneer vending unit, to be<\/p>\n<p>normally stationed before the International Stadium at<\/p>\n<p>W.P ( C) No.22194 of 2009<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>Kaloor. It cannot be said that the proposal contains any<\/p>\n<p>inherent danger or other factor which would be detrimental<\/p>\n<p>to public interest. Conditions can also be imposed by the<\/p>\n<p>licensing authority in the matter of vending.        That is<\/p>\n<p>different from     rejecting  the application, without any<\/p>\n<p>reasons, whatsoever.\n<\/p>\n<p>      5.   Ext.P6 shall therefore stand set aside.      The<\/p>\n<p>resolution taken by the Executive Committee of the GCDA<\/p>\n<p>as evidenced by E. R1 (c) shall also therefore be rendered<\/p>\n<p>ineffected.
