Heard learned counsel for the petioner<\/p>\n<p>                      and the State.\n<\/p>\n<p>                                The petitioner being the husband of the<\/p>\n<p>                      victim        is      languishing             in     jail         since<\/p>\n<p>                      19.11.2009          in      a     case        registered          under<\/p>\n<p>                      Sections 306,201\/34 of the Indian Penal Code.<\/p>\n<p>                                The case of the prosecution is that the<\/p>\n<p>                      marriage was performed 20 years ago and the<\/p>\n<p>                      victim was tortured and due to torture she<\/p>\n<p>                      consumed poison and also administered poison<\/p>\n<p>                      to the children.\n<\/p>\n<p>                                Though         from    the     impugned        order,      it<\/p>\n<p>                      appears that the victim has some fractured<\/p>\n<p>                      injury also but the learned counsel for the<\/p>\n<p>                      State      after      going      through       the     case      diary<\/p>\n<p>                      submits       that     there      is     no    evidence       to    the<\/p>\n<p>                      effect       that     the       petitioner         assaulted        the<\/p>\n<p>                      victim.\n<\/p>\n<p>                                Considering the fact that the case has<\/p>\n<p>                      been     instituted         under      Section        306    of     the<\/p>\n<p>                      Indian Penal code and the victim was married<\/p>\n<p>                      20    years     prior      to    the     occurrence,        let     the<\/p>\n<p>                      petitioner, Prakash Chaudhary, be released on<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>       bail on furnishing bail bond of Rs. 10,000\/-<\/p>\n<p>       (Ten Thousand) with two sureties of the like<\/p>\n<p>       amount    each   to   the     satisfaction     of   the<\/p>\n<p>       learned   C.J.M.,     Gaya,    in   connection      with<\/p>\n<p>       Neemchak Bathani P.S.
