Appellant was absent when called. Respondents were<br \/>\npresent through Shri L.R. Aggarwal, Deputy Secretary &amp; Appellate<br \/>\nAuthority, Ms.Sushma Kataria, Under Secretary and CPIO, CBEC and<br \/>\nShri Dalveer Solanki, Assistant Commissioner and CPIO, Delhi<br \/>\nCommissionerate.\n<\/p>\n<p>2.    Respondents stated that a petition from the appellant dated<br \/>\n18.12.2008 addressed to CPIO, CBEC was received comprising the<br \/>\nfollowing queries:-\n<\/p>\n<blockquote><p>      &#8220;1.   Whether some officers of the Customs &amp; Central Excise,<br \/>\n            Delhi, who had earlier proceeded on voluntary retirement,<br \/>\n            have been re-inducted \/ re-employed into the department.\n<\/p><\/blockquote>\n<blockquote><p>       2.   If yes, please give the names and designations of the above<br \/>\n            said officers.\n<\/p><\/blockquote>\n<blockquote><p>       3.   What were the grounds given by them for their re-\n<\/p><\/blockquote>\n<blockquote><p>            induction \/ re-employment into the department.\n<\/p><\/blockquote>\n<blockquote><p>       4.   Under what law\/rules\/regulations these officers have been<br \/>\n            re-inducted \/ re-employed into the department.&#8221;\n<\/p><\/blockquote>\n<p>3.     As the queries were open-ended and non-specific, CPIO, through<br \/>\nher communication dated 16.03.2009, transferred appellant&#8217;s petition<br \/>\nto all the Chief Commissioners of Customs under Section 6(3) of the RTI<br \/>\nAct for providing information to the appellant directly, assuming that<br \/>\nthe query was aimed at receiving information for voluntary retirees in<br \/>\nthe offices of the public authority all over the country. However, when<br \/>\nthe<br \/>\nfirst-appeal (dated 16.03.2009) was filed before the Appellate Authority<br \/>\nby the appellant, it was noted that she desired to receive information<br \/>\nonly about the Delhi Commissionerate of Excise and Customs. On the<br \/>\norders of the Appellate Authority dated 09.04.2009, CPIO again wrote to<br \/>\nAT-22072009-15.doc<br \/>\n<span class=\"hidden_text\">                                                             Page 1 of 2<\/span><br \/>\n the Chief Commissioner of Customs (Delhi Zone) on 30.06.2009<br \/>\nrequesting the latter to provide the information directly to the<br \/>\nappellant. Subsequently, the CPIO, Delhi Commissionerate provided a<br \/>\nreply on 06.07.2009 stating as follows:-\n<\/p>\n<blockquote><p>      &#8220;Please refer to your application dated 18.12.08 on the above<br \/>\n      cited subject forwarded to this office by Smt.Sushma<br \/>\n      Kataria, Under Secretary \/ CPIO (Ad.IIB) vide letter F.No.A-<br \/>\n      26011\/24\/2009-Ad.IIA dated 30.06.2009 received in this office<br \/>\n      vide Assistant Commissioner (CCU)&#8217;s letter C.No.CCU(DZ)CX\/RTI\/<br \/>\n      63\/2009\/6209 dated 30.06.09.\n<\/p><\/blockquote>\n<blockquote><p>      Reply is as under:-\n<\/p><\/blockquote>\n<blockquote><p>      Atleast one person named Sh.Ramesh Chander Sharma, Supdt.<br \/>\n      Now Assistant Commissioner has rejoined the department after<br \/>\n      availing VRS. (Copy of Estt. Order No.234\/1999 dated 01.01.09 is<br \/>\n      enclosed) [sic].&#8221;\n<\/p><\/blockquote>\n<p>4.
