JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\nAppeal, preferred under Clause 15 of the Letters Patent, arises from<br \/>\nthe judgment and order dated 2nd July 1998 passed by the<br \/>\nlearned Single Judge in above Special Civil Application No. 2526 of<br \/>\n1998.\n<\/p>\n<p>\tThe<br \/>\nappellant-writ petitioner was then a Sarpanch in Matar Gram<br \/>\nPanchayat. On 24th March 1998, the District Development<br \/>\nOfficer, Kheda issued a notice under Section 59(1) of the Gujarat<br \/>\nPanchayats Act, 1993 calling upon the petitioner to show cause why,<br \/>\nfor the reasons stated in the said notice, the appellant be not<br \/>\nsuspended from the office of Sarpanch. Feeling aggrieved, the<br \/>\nappellant preferred above Special Civil Application No. 2526 of 1998<br \/>\nunder Article 226 of the Constitution. The learned Single<br \/>\nJudge was pleased to dismiss the petition. Therefore, the present<br \/>\nAppeal.\n<\/p>\n<p>\tIn<br \/>\nview of passage of time, the cause of action does not survive.
