NO\n\t\t\n\t\n\n \n\n \n=============================================\n \n\nCHAMPABEN,\nWIDOW OF UMEDJI @ KANUJI MAGANJI - Appellant(s)\n \n\nVersus\n \n\nTHE\nSTATE OF GUJARAT - Opponent(s)\n \n\n============================================= \nAppearance\n: \nMR MAHENDRA K PATEL for\nAppellant(s) : 1, \nMR KL PANDYA, APP  for Opponent(s) :\n1, \n=============================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.L.DAVE\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE R.M.CHHAYA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/02\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p> (Per : HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>1.\tThe<br \/>\nappellant is convicted by Sessions Court, Patan for the offence of<br \/>\nhaving committed murder of her son-in-law Jagdishbhai Dahyabhai by<br \/>\npouring kerosene on him and setting<br \/>\nhim ablaze on 25.10.1999 at about 8.00 p.m.,  in her house near<br \/>\nBageswar Mahadev Temple, Patan and hence this appeal.\n<\/p>\n<p>2.<br \/>\nThe prosecution case in brief is that the appellant, her daughter and<br \/>\nher son-in-law Jagdishbhai Dahyabhai were staying together at the<br \/>\nappellant&#8217;s house near Bageswar Mahadev Temple at Patan.  It is<br \/>\nfurther case of the prosecution that the appellant was maintaining<br \/>\nsome illicit relationship which was objected to by her son-in-law,<br \/>\nand therefore, on 25.10.1999 at about 8.00 p.m., upon  the deceased<br \/>\nJagdishbhai rebuking the appellant about her relationship, she poured<br \/>\nkerosene on his person and set him to fire.  After the incident,  the<br \/>\ndeceased went to his parental house. Before his mother and father  he<br \/>\ngave an oral dying declaration about the appellant having set him to<br \/>\nfire.   On the next day of the incident the deceased  was taken to<br \/>\nhospital.  He also lodged an FIR with the police.  In the FIR also he<br \/>\ngave the same reason for his injuries.  The Executive Magistrate<br \/>\nrecorded dying declaration, where also he gave the same reason  for<br \/>\nhis burns injuries.  Deceased Jagdishbhai  ultimately succumbed to<br \/>\nthe injuries after about 9 days.  The FIR which was initially lodged<br \/>\nfor attempt to murder thus became an FIR for murder by adding Section<br \/>\n302 of the Indian Penal Code.  The police  investigated the case and<br \/>\nfiled chargesheet in the Court of J.M.F.C., Patan who, in turn,<br \/>\ncommitted  the case to the Court of Sessions and Sessions Case No.339<br \/>\nof 2002 came to be registered. Charge was framed against the accused<br \/>\nat Exh.13.  She pleaded not guilty to the charge and claimed  to be<br \/>\ntried.\n<\/p>\n<p>3.\tConsidering<br \/>\nthe evidence led by the prosecution, the trial court came to a<br \/>\nconclusion that the prosecution was successful in establishing charge<br \/>\nof murder against the appellant and therefore convicted the appellant<br \/>\n for the offence of murder and sentenced her to undergo imprisonment<br \/>\nfor life and to pay a fine of Rs.200\/-, in default, to undergo<br \/>\nfurther simple imprisonment for one month, by judgment and order<br \/>\ndated 10.6.2005, rendered in Sessions Case No.339 of 2002. This has<br \/>\ngiven rise to the  present appeal.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr.Mahendra Patel for the appellant submitted  that the<br \/>\ntrial court has erred in relying on the dying declaration before the<br \/>\nExecutive Magistrate.  The evidence of the endorsement made by doctor<br \/>\nabout the conscious state of mind of the deceased, as emerging from<br \/>\nthe deposition of the doctor and that of the Executive Magistrate are<br \/>\nin conflict and therefore the dying declaration ought not to have<br \/>\nbeen accepted by the trial court.  He submitted further that,  in<br \/>\nfact,  it was an incident of suicide which has been given the<br \/>\nshape\/colour of a murder.  Since the deceased  used to drink and did<br \/>\nnot work, he was abused by his relatives particularly, his<br \/>\nmother-in-law,  which developed in  him a sense of repentance, and<br \/>\nhe, therefore, set himself  to fire and committed suicide.\n<\/p>\n<p>Mr.Patel submitted that the evidence of other witnesses is doubtful<br \/>\nand therefore the appeal may be allowed and the  conviction may be<br \/>\nset aside.\n<\/p>\n<p>5.\tLearned<br \/>\nAPP Mr.K.L.Pandya has opposed this appeal.  According to him, the<br \/>\nevidence of endorsement does not hit the dying declaration recorded<br \/>\nby the Executive Magistrate inasmuch as it inspires confidence.<br \/>\nMr.Pandya submitted that the endorsement by the doctor is only a rule<br \/>\nof prudence  and not a  necessity of  law.  If an independent officer<br \/>\nlike Executive Magistrate satisfies about the conscious state of mind<br \/>\nof such declarant and records the dying declaration in absence<br \/>\nof any other lacuna in recording the dying declaration, the dying<br \/>\ndeclaration becomes valid and may be accepted at face value.<br \/>\nMr.Pandya submitted that the other doubts raised by learned advocate<br \/>\nfor the appellant are not good enough to brush aside consistent<br \/>\nevidence  in the form of dying declaration before Executive<br \/>\nMagistrate, oral dying declaration before father and mother of the<br \/>\ndeceased and the FIR by the deceased himself.  Mr.Pandya, therefore,<br \/>\nsubmitted that the judgment and order may not be interfered with in<br \/>\nexercise of appellate jurisdiction.\n<\/p>\n<p>6.\tWe<br \/>\nhave examined the record and proceedings in context of rival side<br \/>\nsubmissions and we find that the guilt of the accused-appellant is<br \/>\nproved through the evidence of the Executive Magistrate Jayantilal<br \/>\nNanalal Contractor at Exh.39.  He states that he had recorded the<br \/>\ndying declaration between 1.45 to 1.50 at night hours, and before<br \/>\ndoing so, he consulted the doctor. The doctor, on the other hand,<br \/>\nstates that he was consulted by the Executive Magistrate at 1.50<br \/>\nhours, and after verifying the condition of the patient, he put his<br \/>\nendorsement at that point of time.  The discrepancy is, therefore,<br \/>\nonly question whether the endorsement is made before recording the<br \/>\ndying declaration or after recording the dying declaration.  Against<br \/>\nthis, the fact remains that the endorsement was made by the doctor<br \/>\nand it was made after examining the patient. It is to be noted that<br \/>\nthe deceased succumbed to the injuries only after 8 days of such<br \/>\ndying declaration.\n<\/p>\n<p>7.\tIt<br \/>\nis also to be noted that what is stated in the dying declaration<br \/>\nabout the cause of death by the deceased is corroborated  by evidence<br \/>\nof Laxmiben Dahyabhai,  P.W. 3 (Exh.21),  before whom he had given<br \/>\noral dying declaration on the same line.  Similar is  the situation<br \/>\nwith the evidence of his father Dahyalal Mohanlal Bhil (Exh.19).\n<\/p>\n<p>8.<br \/>\nAn  attempt is made to assail the prosecution case by saying that<br \/>\ndaughter of the accused and wife of the deceased, Jashiben,  is not<br \/>\nexamined by the prosecution.  In cross-examination of the<br \/>\nInvestigating Officer, Chimanlal Sankalchand Nayak (Exh.44), it was<br \/>\nput to him that he had recorded the statement of Jashiben<br \/>\nJagdishkumar,  which he admits.  He admits that, in that statement,<br \/>\nJashiben stated that there was a dispute between her husband and her<br \/>\nmother  on her husband having taken liquor.  She then stated that she<br \/>\nhad gone to  attend nature&#8217;s call  and when she came back, her<br \/>\nhusband was already ablaze.    This attempt on the part of defence<br \/>\nfails to prove that the deceased had set himself to fire.<br \/>\nDifferently put, this small titbits of doubtful circumstances do not<br \/>\nabrogate the direct, strong and independent evidence in the form of<br \/>\ndying declaration recorded by the  Executive Magistrate so also the<br \/>\nFIR recorded by  the police, as given to them  by the deceased.\n<\/p>\n<p>9.\tThe<br \/>\noverall assessment of evidence thus would be that there is no reason<br \/>\nto doubt the dying declaration which establishes the guilt of the<br \/>\naccused-appellant and the doubts which are raised cannot be<br \/>\nconsidered to be reasonable doubts, which would be good enough  to<br \/>\nrender the evidence in the form of dying declaration unbelievable.<br \/>\nWe do not find any merits in the appeal.
