Belt, Madhugiri Taluk, Tumkur\nDistrict; which is described as Block Area 1-9 in\n\n,vdthe*impugned notification vide Annexure~C or direct\n':_the respondents to postpone the said action till the\n'standing crops are removed from the fields, etc.\n\nThese petitions coming on for Preliminary\n\n \n\nh\"nhearing* on this day, B.S Patil J., made the\nxfollowing\nORDER\n<\/pre>\n
The learned Addl. Government Advocate is<\/p>\n
directed to take notice for respondents 1 to 3.<\/p>\n

grievance and the same is directed against; the<\/p>\n
notification issued by the 2″‘ respondent i1e},%thel<\/p>\n
Deputy Director, Department oft Mines Vandi Geology,<\/p>\n
Tumkur District, Tumkur, proposingl pu\u00a71i\u00a2 _a\ufb01c\u00a7i\u00a2n<\/p>\n
for quarrying the sand Vaocumu1ated._in, Kumudhyathii<\/p>\n
river belt. The petitioners are the.residents of
\nUpharalli and Yakarlahalli*Vyillage in Madugiri
\nTaluk, Tumkur,_ District\u00bb *A3 lfhel” claim of the<\/p>\n
petitioners iislithatlytheirpAlands”\u00b0are adjacent to<\/p>\n
Kumudhvathipdgriyer ‘,belt,””wYakarlahal1i village,
\nMadugiri ‘Taluh fend; they _are carrying’ agricultural<\/p>\n
operations\u00bb for “;he_”p\u00a7st several years. They have<\/p>\n
., presently grown, different crops including chilli,<\/p>\n
dr_maize and–_panana and dug up bore–wells in their<\/p>\n
lands to irrigate the crops.\n<\/p>\n
3z’fThe grievance of the petitioners is that by<\/p>\n
finviting’ bids fixing” the date of auction on 19″”<\/p>\n
* February 2010 for quarrying the sand accumulated<\/p>\n
u*_around the lands of the petitioners, the authorities<\/p>\n
have virtually posed a threat to the standing crops<\/p>\n
of the petitioners and also to their lands. The<\/p>\n

petitioners claim that their lands bearing Sy.
\nNos.61\/1, 61\/2 and 61\/3 of Yarkarlahalli village,<\/p>\n
situated adjacent to Kumudhvathi river .belt_ are<\/p>\n
going to be seriously affected if the dp\u00a3\u00a2p\u00a7sea_<\/p>\n
auction is proceeded with.\n<\/p>\n
4. Learned counsel for 2the”~petitionersVg\u00a7ri.<\/p>\n
Satish M.Doddamani bp inviting our attentien to thel<\/p>\n
materials placed on record including the Surveyor’s
\nreport submits that the lands of the_petitioners are
\nprotected by sand deposits along side of their lands<\/p>\n
and the said deposits act as,a buns protecting their<\/p>\n
,lands \u00a3rom_inundation of water over–flowing from the<\/p>\n
river. ‘Once the sand deposits adjoining the land is<\/p>\n
removed, the crops grown in the petitioners’ lands<\/p>\n
..are lik\u00e9ly to be ekposed to vagaries of nature that<\/p>\n
‘may_result~on over–flow of water in the river.<\/p>\n
‘_iS. Hd\ufb01ha learned Addl. Government Advocate on<\/p>\n
irinstructions submits that removal of sand<\/p>\n
‘ accumulated along Kumudhvathi river belt will not<\/p>\n
“‘pose any threat either to the fertility of the lands<\/p>\n
dkpor to the bund across the lands. He further submits<\/p>\n
that appropriate conditions will be incorporated<\/p>\n
while executing the lease deeds ensuring that the<\/p>\n

lands are not exposed to the threat of being
\ninundated by removal of the deposits of sand along
\nthe lands forming” as protection against the? OVQI”<\/p>\n
flow of water into the lands. Apart from the same,<\/p>\n
the Court is also assured that all necessary caret<\/p>\n
and caution will be taken by~-thel department ‘toh<\/p>\n
ensure that proper conditions are incorporated while<\/p>\n
executing the lease deed’ to dtake 1earP”~Of: thel<\/p>\n
adjoining lands including_b\u00a7 way of fixing maximum
\nlimit up to which the excavation work can be done.<\/p>\n
6. We .are also vof_ the; slew that while<\/p>\n
permitting_1″tne_h,sand%_ quarrying operation, the
\nauthorities will have to take care to see that the<\/p>\n
standing crops~5 adjoining the bunds are not<\/p>\n
vhdestroyed.”xHoweuerg if it is found that the crops<\/p>\n

petitioners; this direction shall not come in the<\/p>\n
lxway of the authorities proceeding in accordance with<\/p>\n

7. in the light of the submissions made by the<\/p>\n
Vlearned Addl. Government Advocate and in View of<\/p>\n
the fact that the proposed auction is scheduled to<\/p>\n
take place today, we are not inclined to stop the<\/p>\n

auction proceedings. But, we make it clear that<\/p>\n
while the auction can go on the authorities shall<\/p>\n
ensure all safety measures by way of incorporating<\/p>\n
proper conditions in the lease deed to be executed<\/p>\n
so as to protect the lands adjoining *Kumudhvathi ”<\/p>\n
river belt including the petitioners herein, which<\/p>\n
are notified for auction._ The authorities are also<\/p>\n
directed to ensure that no nechaniged guarr\u00a7ing is<\/p>\n
permitted in those places,VW
