   The   Court    :   This    is   an   application      by   one   of   the<\/p>\n
defendants in a partition suit seeking transfer of the suit<\/p>\n
to this Court. Of the several grounds cited, it is said that<\/p>\n
since the petitioners herein are ladies who ordinarily reside
\n                                             2<\/span><\/p>\n
in Calcutta it would be difficult for them to contest the<\/p>\n
suit in Chinsurah.\n<\/p>\n
      It is also suggested that since there is a suit pending<\/p>\n
in the City Civil Court relating to the business of the<\/p>\n
family   which      is    covered       under      schedule-B       to    the     plaint<\/p>\n
relating to the Chinsurah suit, it is desirable that the<\/p>\n
Chinsurah suit should be transferred to Calcutta. The other<\/p>\n
ground canvassed is that there is an application for grant of<\/p>\n
probate pending in this Court since 2007 relating to the Will<\/p>\n
of one Ratan Mala Saha and it is through Ratan Mala Saha that<\/p>\n
the plaintiff in the Chinsurah suit has traced the alleged<\/p>\n
joint properties.\n<\/p>\n
      None   of    the    other       parties      to   the    suit      support    this<\/p>\n
application. It is evident from the plaint relating to the<\/p>\n
Chinsurah    suit    that        a    substantial       part   of     the      immovable<\/p>\n
properties    is    in    Chinsurah         and    Chinsurah     was      the    natural<\/p>\n
forum for the action. It is also evident that the scope of<\/p>\n
the   City   Civil       Court       suit   is    restricted     to      the    business<\/p>\n
relating     to   the     foreign       liquor     business     and      disputes     in<\/p>\n
connection therewith and may not have much of an impact on<\/p>\n
the partition suit pending in Chinsurah. Further, one of the<\/p>\n
petitioners as the propounder of the Will of Ratan Mala Saha
\n                                    3<\/span><\/p>\n
has not taken any meaningful steps since the year 2007 for<\/p>\n
the grant of probate by this Court.\n<\/p>\n
      On an application under Clause 13 of the Letters Patent,<\/p>\n
the convenience of the petitioners is not the sole criterion;<\/p>\n
the    convenience   of   the   other   parties   also   have   to   be<\/p>\n
ascertained. In the present case, the other parties do not<\/p>\n
support the application for transfer of the Chinsurah suit<\/p>\n
and it appears from the plaint relating to the suit that the<\/p>\n
plots of land which form the subject matter of the suit are<\/p>\n
within the jurisdiction of the Chinsurah Court.<\/p>\n
      ALP No.21 of 2010 is dismissed. There will be no order<\/p>\n
as to costs.\n<\/p>\n
      Urgent certified photocopies of this order, if applied<\/p>\n
for, be supplied to the parties subject to compliance with<\/p>\n
all requisite formalities.\n<\/p>\n
