K  Mtiniiifenkatappa, 2nd defendant has been in possession as<\/p>\n
  and katha stands in his name. He has dug the<\/p>\n
 borewell and has got power connection and has also<\/p>\n

raised loan. The case of the plaintiffs is false and that
\ndefendant has been in possession of the suit schediile
\nproperty for more than 12 years and has
\nadverse possession. The suit property wasps\u00bb

8. As regards the claim of._p}aintiff force if<\/p>\n
it is not pleaded by the  ‘the property\ufb01ifell to
\nthe share of Bangimuniyapp\u00a7.,.  have
\nproduced Exs.D.\u00e9l3.,;’ 44  Muniga,
\nPapanna and   if Vpfoussession of the
\nproperty    1 acre 8 guntas
\nand 1 acre’   and they executed<\/p>\n

PVlfi ‘\u00ab:;-_”ef_pi’,  fffp,laintiff has admitted in his cross<\/p>\n
fflfffffezgamination’  his grand father Nadupiga had 3 sons
\n A.l\\\/{_.1’1ni’yappa, Papanna and Muniswamy. However,
\n  plaintiffsfflfhave not pleaded their relationship in the plaint.
\nif on the ground that the mutation stood in the name<\/p>\n
  the plaintiffs, a partition is claimed. The trial Court on<\/p>\n
consideration of the mutation entries at EX.P.2 to R6 has<\/p>\n
held that in view of the tenancy law, the entry was made<\/p>\n
in the name of the plaintiffs but the said V.<\/p>\n
supported by any material. A perusal of l’   <\/p>\n
45 reveals that the properties were <\/p>\n
father of 21361 defendant — Munivenl_<atappa'–and  <\/p>\n
of the matter has not been dispute.d'by PW-it  and
\nthese documents have  at an

\nEx.D.44 the"re"ctiai -of property is shown as a<\/p>\n
boundaryantyd  E3x,_D;'45.'V'the property sold by Muniyappa,<\/p>\n
  was shown as share of lV\u00a3uniyappa's<\/p>\n
broth.erj\ufb01luiiisvvarny' is shown. These recitals in the safe<\/p>\n
 deed atduan undisputed point of time establishes that there<\/p>\n
 partition among Papanna, Muniyappa and<\/p>\n
 they were all in individual and independent<\/p>\n
 possession and they alienated the suit property to the<\/p>\n
'fjfather of 2nd defendant. Considering the material<\/p>\n
documents produced by the defendant, it clearly<\/p>\n
establishes that the piaintiffs have failed to prove that._t:h.e'~\u00bb.vV<\/p>\n
properties are ancestral properties and failed to.A"prove.\u00bbtas  ~<\/p>\n
to why they have not joined all the r;<:cee.sary <\/p>\n
further have also not proved their intlerestl  3f<\/p>\n
