Justice V.GIRI\n\n Dated :13\/12\/2007\n\n O R D E R\n                                     V.GIRI,J.\n\n                              -------------------------\n\n                       W.P ( C) No.  36817 of 2007\n\n                              --------------------------\n\n                 Dated this the 13th  December, 2007\n\n\n                                J U D G M E N T\n<\/pre>\n<p>       The   petitioner   is   aggrieved   by   Exhibit-P6   order   passed   by<\/p>\n<p>the Chief Conservator of Forests  deciding to impose a penalty of<\/p>\n<p>withholding of  1\/3rd of the pension of the petitioner for a period<\/p>\n<p>of   two   years     from   the   date   of   his   retirement.     There   is   also   a<\/p>\n<p>direction   that   the   suspension   period   from     9.10.1982   to<\/p>\n<p>31.5.1990 shall be treated as duty for all purposes except for the<\/p>\n<p>purpose of calculation of   earned leave.   The salary for the said<\/p>\n<p>period was limited to  subsistence allowance, as already decided<\/p>\n<p>earlier.\n<\/p>\n<p>       In my view, the petitioner has an efficacious  remedy before<\/p>\n<p>the  Government  as against Exhibit-P6.  If the petitioner files an<\/p>\n<p>appeal\/revision   against   Exhibit-P6   before   the   1st  respondent,<\/p>\n<p>within   two   weeks   from   today,   the   same   shall   be   treated   as<\/p>\n<p>within   time   and   appropriate   decision,   in   accordance   with   law,<\/p>\n<p>shall   be   taken,   after   hearing   the   petitioner,   within   a   period   of<\/p>\n<p>three months thereafter.\n<\/p>\n<p>                                                                (V.GIRI, JUDGE)<\/p>\n<p>ma<\/p>\n<p> K.THANKAPPAN,J<\/p>\n<p>CRL.A.
