Vijay Panjiyar son of Surendra\n           Panjiyar\n           4.Hira Lal Panjiyar\n           5.Gopal Panjiyar, both sons of Pawan\n           Panjiyar\n           All are resident of Hospital Road   Benta,\n           P.S.Laheriasarai, District Darbhanga\n                   ----------------------------------\n<\/pre>\n<p>03\/   14.11.2011            This     appeal      has     been<\/p>\n<p>                    filed against the judgment of<\/p>\n<p>                    acquittal      dated        20.05.2011<\/p>\n<p>                    passed by       Additional Sessions<\/p>\n<p>                    Judge, Fast Track Court No.I,<\/p>\n<p>                    Darbhanga in Sessions Trial No.<\/p>\n<p>                    214 of 2008.\n<\/p>\n<p>                            Charges were framed under<\/p>\n<p>                    Sections      341,   323,   324,     307,<\/p>\n<p>                    384,    379    and   427\/34     of    the<br \/>\n<span class=\"hidden_text\">             2<\/span><\/p>\n<p>Indian          Penal     Code        against<\/p>\n<p>respondent nos. 2 to 5.<\/p>\n<p>        It      appears        that    P.Ws.5<\/p>\n<p>and     6       being     own         brothers<\/p>\n<p>deposed         that     injured       Laxman<\/p>\n<p>Sharma was called by Raja Yadav<\/p>\n<p>alias    Rajeshwar         Yadav      (P.W.4)<\/p>\n<p>who      took       the        injured     to<\/p>\n<p>Hospital but P.W.4 has denied<\/p>\n<p>the evidence of P.Ws. 5 and 6<\/p>\n<p>which hit the prosecution case.<\/p>\n<p>        In our view, the judgment<\/p>\n<p>of acquittal does not require<\/p>\n<p>any interference by this Court.<\/p>\n<p>Accordingly,            this    appeal      is<\/p>\n<p>dismissed.\n<\/p>\n<p>        Since we did not find any<\/p>\n<p>merit in the appeal itself, the<\/p>\n<p>delay in filing this appeal is<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>          condoned.\n<\/p>\n<\/p>\n<p>                     (Shyam Kishore Sharma, J.)<\/p>\n<p>Tahir\/-              (Dinesh Kumar Singh,J.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
