The deceased Mr. Sabbirbhai died in said accident aged<br \/>\n\tabout 23 years, his birth date being in 1963 as per the school<br \/>\n\tleaving certificate vide exh 34.  He had already obtained learning<br \/>\n\tlicence for light motor vehicle and was on way to obtain licence for<br \/>\n\theavy vehicle.  He had also got prepared passport vide exh 49 and<br \/>\n\twas searching for job opportunity abroad. Unfortunately, his career<br \/>\n\twas cut short as a result of incident.  The age of father is 50<br \/>\n\tyears and mother is aged about 48 years.  The parents have filed<br \/>\n\tclaim petition.  The deceased was getting Rs. 350\/- per month as per<br \/>\n\tsay of claimant no. 2 &#8211; father.\n<\/p>\n<p>Therefore,<br \/>\n\tTribunal has examined matter on the basis of 1\/3 dependency benefit<br \/>\n\tas available in case of unmarried person, which comes to Rs. 150\/-<br \/>\n\tper month and on that basis annual figure comes to Rs. 1800\/- to<br \/>\n\twhich 15 was been applied, total of which amount comes to Rs.<br \/>\n\t27,000\/- towards future economic loss.  The dead body of deceased<br \/>\n\twas brought to their native place, and for that purpose they had to<br \/>\n\tspent Rs. 1500\/-, which was considered to be awarded.  The<br \/>\n\tconventional sum of Rs. 10,500\/- for shock, suffering, loss of<br \/>\n\texpectancy of life has been awarded by Tribunal.  Thus, total amount<br \/>\n\tcomes to Rs. 39,000\/-.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Hakim raised contention before this Court that deceased<br \/>\n\twas having marriageable age.  According to his father, deceased<br \/>\n\twould have married soon that facts has been admitted by his father.<br \/>\n\tTherefore, he submitted that instead of 1\/3 dependency benefit,<br \/>\n\tclaimants are entitled 2\/3 dependency benefit and only 1\/3 is to be<br \/>\n\tdeducted on the salary of deceased.\n<\/p>\n<p>He<br \/>\n\talso raised contention that future prospect of income is not taken<br \/>\n\tinto account by Tribunal.  Therefore, Rs. 50,000\/- has been claimed<br \/>\n\tby claimants and claimants are entitled that much amount from<br \/>\n\tTribunal.  Except that no other submission is made by learned<br \/>\n\tadvocate Mr. Hakim before this Court.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Acharya appearing for respondent supported award passed<br \/>\n\tby claims tribunal.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by both learned advocates.<br \/>\n\tUltimately, this Court has to consider whatever amount as awarded by<br \/>\n\tTribunal, whether it is just, fair and reasonable or not.  I have<br \/>\n\texamined matter on all angle as contention raised by learned<br \/>\n\tadvocate Mr. Hakim.\n<\/p>\n<p>Looking<br \/>\n\tto the age of parents of deceased, 15 multiplier is not available to<br \/>\n\tclaimants, then it comes to only ten multiplier not more than that.<br \/>\n\tIf 1\/3 is deducted being personal expenses, then it comes to Rs.<br \/>\n\t200\/- per month, which makes difference of Rs. 50\/- more, in monthly<br \/>\n\tdependency, but looking to the age of parents and deceased was<br \/>\n\tunmarried aged about 23 years, total claim was made for Rs.<br \/>\n\t50,000\/-.\n<\/p>\n<p>According<br \/>\n\tto my opinion, Tribunal has considered family prospect and also<br \/>\n\tfuture prospect income, then applied 15 multiplier which will<br \/>\n\tultimately comes to same figure either multiplier may be reduced or<br \/>\n\tdependency benefits may be increased.\n<\/p>\n<p>The<br \/>\n\taccident occurred on 15\/9\/1984 and claim petition is of 1985, at<br \/>\n\tthat relevant time, Tribunal has examined issue on the basis of law,<br \/>\n\twhich was applied at that time. Looking to the reasoning given by<br \/>\n\tTribunal, according to my opinion, Tribunal has rightly awarded<br \/>\n\tcompensation of Rs. 39,000\/-, for that Tribunal has not committed<br \/>\n\tany error while passing such award in favour of claimants.\n<\/p>\n<p>The<br \/>\n\tcontentions raised by learned advocate Mr. Hakim are examined by<br \/>\n\tthis Court, if dependency benefit is increased, then multiplier is<br \/>\n\tto be reduced, which resulted into around figure, which has been<br \/>\n\tawarded by Tribunal.\n<\/p>\n<p>Therefore,<br \/>\n\taccording to my opinion, contentions raised by learned advocate Mr.<br \/>\n\tHakim, can not be accepted and same are rejected.  The Tribunal has<br \/>\n\tawarded just, proper and reasonable compensation in favour of<br \/>\n\tclaimants, for that, Tribunal has not committed any error, which<br \/>\n\twould require interference by this Court.\n<\/p>\n<p>Hence,<br \/>\n\tthere is no substance in the present appeal.
