Justice R.BASANT\n\n Dated :24\/11\/2006\n\n O R D E R\n                              R.BASANT, J.\n\n                     ------------------------------------\n\n                     Crl.M.C.NO.3893 OF 2006\n\n                     ------------------------------------\n\n             Dated this the 24th day of November, 2006.\n\n\n                                  ORDER\n<\/pre>\n<p>      The   petitioner   is   the   accused   in   a   prosecution   under<\/p>\n<p>Section   138   of   the   N.I   Act.     The   learned   counsel   for   the<\/p>\n<p>petitioner   submits   that   the   complainant&#8217;s   evidence   is   already<\/p>\n<p>closed and the accused who is examining himself under Section<\/p>\n<p>315 CR.P.C is in the witness stand.  He has been cross examined<\/p>\n<p>in part and not completed yet.  At this stage, counsel submits, an<\/p>\n<p>application   was   filed   by   the   complainant   under   Section   311<\/p>\n<p>Cr.P.C  producing  certain documents requesting that he may be<\/p>\n<p>permitted   to   examine   himself   further.     That   application   was<\/p>\n<p>opposed   and   the   learned   Chief   Judicial   Magistrate   by   the<\/p>\n<p>impugned   order,   which   is   produced   as   Annexure-A,   permitted<\/p>\n<p>the   production   of   documents   and   further   examination   of   the<\/p>\n<p>complainant.  The learned counsel for the petitioner submits that<\/p>\n<p>this   procedure   adopted   by   the   learned   Magistrate   is   incorrect.\n<\/p>\n<p>Under   Section   311   Cr.P.C,   witnesses   can   be   summoned,   but<\/p>\n<p>documents cannot be produced or received.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.NO.3893 OF 2006                 2<\/span><\/p>\n<p>      2.     I  am unable  to accept the  contentions  of the  learned<\/p>\n<p>counsel   for   the   petitioner.     The   contention   is   inherently<\/p>\n<p>unsustainable.     It   omits   to   take   note   of   the   width,   sweep   and<\/p>\n<p>amplitude of the powers under Section 311 Cr.P.C.  The learned<\/p>\n<p>Magistrate has in the order explained why further evidence has<\/p>\n<p>become necessary.   There  was a challenge against the capacity<\/p>\n<p>of the complainant to raise the amount to advance the loan to the<\/p>\n<p>accused to discharge which the cheque was allegedly issued.  In<\/p>\n<p>the light of that challenge in cross examination, the complainant<\/p>\n<p>wanted   further   documents   to   be   produced   and   himself   to   be<\/p>\n<p>recalled for further examination.  In any view of the matter, I am<\/p>\n<p>unable to find any such vice vitiating the impugned order which<\/p>\n<p>would justify this Court invoking the powers under Section  482<\/p>\n<p>Cr.P.C to interfere with that order.\n<\/p>\n<p>      3.     The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p>the accused is remaining part examined in the witness stand and<\/p>\n<p>at   this   stage,   the   complainant   may   not   be   permitted   to   recall<\/p>\n<p>himself and produce any further documents.  I have no reason to<\/p>\n<p>assume  that  the  learned  Magistrate  would proceed to further<\/p>\n<p>examine  the  complainant   before  cross  examination    of   the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.NO.3893 OF 2006            3<\/span><\/p>\n<p>accused is completed.  No directions in that regard also deserve<\/p>\n<p>to be issued.\n<\/p>\n<p>        4.
