Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/09\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n                W.P.C.NO. 30056 OF 2008\n              ------------------------------------------\n\n             Dated     22nd     September          2009\n\n\n                          JUDGMENT\n<\/pre>\n<p>          This petition is filed under Article 226 of<\/p>\n<p>Constitution of India by the father of the deceased<\/p>\n<p>Joseph alias Maya brother, who died in a suspicious<\/p>\n<p>circumstance  on    the      night       of      20\/7\/2006   in  his<\/p>\n<p>residence at Vazhikkadavu              in Theekoy         village of<\/p>\n<p>Kottayam district, for a writ of mandamus directing<\/p>\n<p>respondents 3 and 4, Deputy Superintendent of Police<\/p>\n<p>and Sub Inspector of Police to conduct proper and<\/p>\n<p>effective investigation on Ext.P1 FIR registered under<\/p>\n<p>Section 174 of Code of Criminal Procedure on the<\/p>\n<p>unnatural death.\n<\/p>\n<p>         2.   Learned counsel appearing for petitioner<\/p>\n<p>and learned Government Pleader were heard.<\/p>\n<p>         3.   As     directed,          the      fourth   respondent<\/p>\n<p>investigating officer filed a report stating that a<\/p>\n<p>case was registered under Section 174 of Code of<\/p>\n<p>Criminal Procedure based on the statement of Cyril,<\/p>\n<p>elder brother&#8217;s son of the deceased and the enquiry<\/p>\n<p>WPC 30056\/08<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>conducted revealed that   the deceased along with one<\/p>\n<p>Sijo  and his friends had gone to  Vagamon  for sight<\/p>\n<p>seeing and thereafter, came to the house of the<\/p>\n<p>deceased and from there, the deceased and the guests<\/p>\n<p>consumed liquor till 1.30 a.m    on 20\/7\/2006 and as<\/p>\n<p>instructed by the deceased,    Sijo and   the friends<\/p>\n<p>slept on the ground floor and deceased went upstairs<\/p>\n<p>and slept on a table. In the morning, when Sijo went<\/p>\n<p>to the upstairs, the body of the deceased was found<\/p>\n<p>lying on the floor with oozing blood from his nose and<\/p>\n<p>head. Postmortem certificate establish that death was<\/p>\n<p>due to head injury. According to the statement, it is<\/p>\n<p>revealed   that deceased  was  in    the    habit   of<\/p>\n<p>consuming liquor and no suspicious circumstance was<\/p>\n<p>found out.\n<\/p>\n<p>           4.  Learned    counsel    appearing    for<\/p>\n<p>petitioner submitted that  by a fall from the   table<\/p>\n<p>a  fatal head injury will not be caused   and it is a<\/p>\n<p>suspicious circumstance. It  is also argued that  fact<\/p>\n<p>that Sijo and friends were  staying  with the deceased<\/p>\n<p>on that night was not known to the brother&#8217;s son of<\/p>\n<p>the deceased, when the statement was given and if a<\/p>\n<p>proper investigation is conducted, truth will come<\/p>\n<p>WPC 30056\/08<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>out.\n<\/p>\n<p>           5.    I find no reason to direct further<\/p>\n<p>investigation   as sought  for.  Apart  from   raising<\/p>\n<p>suspicion, no material is pointed out as to why   Sijo<\/p>\n<p>or friends had to commit a homicide  especially, when<\/p>\n<p>there is no case that they were on inimical terms with<\/p>\n<p>the deceased or that  they are to gain anything by the<\/p>\n<p>death   of   the  deceased.  In  such   circumstances,<\/p>\n<p>petition is dismissed.
