1.\tPetitioner
\n is original accused No.4. He seeks anticipatory bail in connection
\nwith FIR bearing C.R.No.I-135 of 2010 registered at Kamrej Police
\nStation.\n<\/p>\n
2.\tCounsel
\nfor the petitioner  submitted that the petitioner has no criminal
\nantecedents. He would cooperate with the investigation if released.
\nHe drew my attention to the allegations made in the complaint which
\nessentially amount to misuse of fabricated  power of attorney for
\nselling of land of the complainant in favour of accused No.3.  He
\nsubmitted that the said accused has been granted regular bail by this
\ncourt by order dated 25.10.10.\n<\/p>\n
3.\tOn
\nthe other hand, learned APP Shri Sejpal and learned advocate Shri
\nMunshi for the original complainant submitted that against the order
\ngranting regular bail    to  original accused No.3, application for
\ncancellation of bail has been moved before the  Apex Court which is
\npending. They also submitted that the petitioner has not been
\navailable for interrogation.\n<\/p>\n
4.\tAs
\nper the complaint, the petitioner is a person in whose favour the
\nalleged fabricated  power of attorney has been created which has been
\nused for the purpose of sale of land of the complainant in favour of
\naccused No.3.  Accused No.3 has been released on bail. Further, the
\nFIR itself suggests that  the power of attorney was created on blank
\npapers on which accused No.3 had forced the complainant to put his
\nthumb impression.  The complainant does not deny his thumb impression
\non the power of attorney.  I  further find that the alleged incident
\nof accused No.3  compelling the complainant to put his thumb
\nimpression on blank papers  is of 13.10.2006 while the FIR was lodged
\non 1.8.2010.\n<\/p>\n
5.\tConsidering
\nthe above aspects of the matter, the petitioner is ordered to be
\nreleased on bail in the event of his arrest   in connection with
\nC.R.No.I-135 of 2010 of  Kamrej Police Station  upon his   furnishing
\n bond of Rs.25,000\/- (Rupees Twenty Five  Thousand)   with one surety
\nof like amount to the satisfaction of the lower Court and subject to
\nthe following conditions that he:\n<\/p>\n
[A]\tshall
\ncooperate with the investigation and make himself available for
\ninterrogation whenever required.\n<\/p>\n
[B]\tshall
\nremain present at concerned Police Station  on 18th
\nFebruary 2011 between 11:00 am to 2:00 pm:\n<\/p>\n
[C]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any witness so
\nas to dissuade them from disclosing such facts to the Court or to any
\nPolice Officer;\n<\/p>\n
[D]\tshall
\nat the time of execution of bond, furnish the address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[E]
\n\twill not leave India without the permission of the Court and, if is
\nholding a Passport, shall surrender the same before the trial Court
\nimmediately<\/p>\n
[F]\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits.\n<\/p>\n
[G]\tdespite
\nthis order, it would be open for the Investigating Agency to apply to
\nthe competent Magistrate, for police remand of the petitioner. The
\npetitioner  shall remain present before the learned Magistrate on the
\nfirst date of hearing of such application and on all subsequent
\noccasions, as may be directed by the learned Magistrate. This would
\nbe sufficient to treat the accused in the judicial custody for the
\npurpose of entertaining application of the prosecution for police
\nremand. This is, however, without prejudice to the right of the
\naccused to seek stay against an order of remand, if ultimately
\ngranted, and the power of the learned Magistrate to consider such a
\nrequest in accordance with law. It is clarified that the petitioner,
\neven if, remanded to the police custody, upon completion of such
\nperiod of police remand, shall be set free immediately, subject to
\nother conditions of this anticipatory bail order.\n<\/p>\n
\tRule
\nmade absolute accordingly.\n<\/p>\n
