Mr.H.L.\n<\/p>\n<p>\tJani, learned Additional Public Prosecutor, waives service of Rule<br \/>\n\ton behalf of the respondent-State.\n<\/p>\n<p>Present<br \/>\n\tapplication is filed by the applicant under Section 389 of the Code<br \/>\n\tof Criminal Procedure, 1973 to suspend the sentence imposed upon him<br \/>\n\tvide order dated 20th<br \/>\n\tOctober 2010 passed by the learned Special Electricity Judge,<br \/>\n\tMehsana, in Electricity Case No.03 of 2010 by releasing the<br \/>\n\tapplicant-accused on bail during the pendency of the appeal.\n<\/p>\n<p>The<br \/>\n\tlearned Special Electricity Judge, Mehsana by his judgment and order<br \/>\n\tdated 20th October 2010 convicted the applicant for the<br \/>\n\toffences punishable under Section 135(1) of the Indian Electricity<br \/>\n\tAct, 2003 and ordered to undergo rigorous imprisonment for a period<br \/>\n\tof one year and fine of Rs.77,000\/-, and in default of payment of<br \/>\n\tfine, ordered to undergo simple imprisonment for further period of<br \/>\n\tthree months.\n<\/p>\n<p>Heard<br \/>\n\tMrs.Nisha Parikh, learned counsel for the applicant and Mr.H.L.<br \/>\n\tJani, learned Additional Public Prosecutor for the respondent-State.<br \/>\n\tMrs.Parikh has submitted that the applicant had already deposited<br \/>\n\tfine amount of Rs.77,000\/- with the Court.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced before me as well as the<br \/>\n\tjudgment and order of conviction passed by the learned Special<br \/>\n\tElectricity Judge, Mehsana.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the case, I am of the opinion that this is a fit<br \/>\n\tcase to suspend the sentence awarded to the applicant. Hence, the<br \/>\n\tpresent application is hereby allowed. The substantive sentence is<br \/>\n\thereby placed under suspension pending hearing and disposal of the<br \/>\n\tmain appeal and the applicant-original accused is hereby ordered to<br \/>\n\tbe released on same bail,<br \/>\n\tfresh bond.\n<\/p>\n<p>\tBail bond to be executed before the concerned trial Court. Rule<br \/>\n\tis made absolute to the aforesaid extent.\n<\/p>\n<p>Direct<br \/>\n\t\t\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>\tK.
