Thereafter the petitioners moved an<br \/>\napplication under Order 9 Rule 13 C.P.C., but it was dismissed in<br \/>\ndefault. Now an application for restoration of application under Order<br \/>\n9 Rule 13 C.P.C., is pending before the trial Court in which next date<br \/>\nof hearing is 20.8.2010. It is submitted that till the final decision of<br \/>\nproceedings under Order 9 Rule 13 C.P.C., the possession of<br \/>\npetitioners may be protected.\n<\/p>\n<p>      Shri   Avinash    Zargar,     learned   counsel   for   respondent<br \/>\nvehemently opposed the prayer and submitted that the suit was filed<br \/>\nunder section 12(1)(a) &amp; (c) of M.P.Accommodation Control Act, 1961<br \/>\n(hereinafter referred to as &#8216;Act&#8217; for short) against the petitioners as<br \/>\nthey were creating nuisance and also not paying rent.           That four<br \/>\ncriminal cases have been registered against the petitioners for<br \/>\ncreating nuisance in the suit premises.          Apart from this, the<br \/>\npetitioners herein have constructed a temple adjoining to the<br \/>\ntenanted premises.\n<\/p>\n<p>      Considering the fact that the application for restoration of an<br \/>\napplication under Order 9 Rule 13 C.P.C. is pending before the trial<br \/>\nCourt and if the aforesaid proceedings are restored the trial court has<br \/>\nto decide the application filed by the petitioners under Order 9 Rule<br \/>\n                          W.P.No.4313\/2010<\/p>\n<p>     Santosh Shukla &amp; another                      Anoop Lokrash<\/p>\n<p>13 C.P.C., and before the decision of aforesaid application if the<br \/>\npetitioners are dispossessed they may suffer irreparable loss,           and<br \/>\nconsidering the peculiar facts of the case, in the interest of justice,<br \/>\nwe dispose of this matter with following directions :-\n<\/p>\n<p>1.       The trial court &#8211; Ist Civil Judge Class-I, Sagar is directed to<br \/>\ndecide the proceedings for restoration of application under Order 9<br \/>\nRule 13 C.P.C. as M.J.C.No.1\/10 expeditiously.\n<\/p>\n<p>2.       The   respondent       Anoop   Lokrash    is   directed   to   cause<br \/>\nappearance before the trial court in the said proceedings on<br \/>\n20.8.2010. A copy of the said application is supplied to the counsel<br \/>\nfor respondent in the Court by Shri S.D.Khan, who may file reply of<br \/>\nthe application on or before the date. The trial Court shall decide the<br \/>\naforesaid proceedings expeditiously as far as possible within a period<br \/>\nof thirty days from the aforesaid date.           If the proceedings under<br \/>\nOrder 9 Rule 13 CPC are restored, the trial court shall make an<br \/>\nendeavour to decide the aforesaid proceedings expeditiously as far as<br \/>\npossible within a period of thirty days from the date of restoration of<br \/>\nproceedings.\n<\/p>\n<p>3.
