Application No. 476 of 2010.\n<\/p>\n<p>2.\tThe<br \/>\napplicant herein is the original complainant of the criminal<br \/>\ncomplaint lodged against respondents alleging that the accused in<br \/>\nconspiracy with each other inflicted severe blows by different<br \/>\nweapons upon the injured Vikrambhai.  The respondents 2 to 6 filed<br \/>\napplication for regular bail being Criminal Misc. Application No.<br \/>\n476\/2010 before the trial court which was allowed.  Being aggrieved<br \/>\nby the said order, the present application is preferred.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Kapadia, learned advocate appearing for the applicant submitted that<br \/>\ninitially the accused were absconding and they could be arrested only<br \/>\nafter six to seven days of the complaint.  He submitted that the<br \/>\naccused persons are very dangerous and their remaining outside jail<br \/>\nshall pose danger to the life and liberty of the complainant and<br \/>\nother witnesses.\n<\/p>\n<p>4.\tAs<br \/>\na result of hearing and having perused the documents on record, it<br \/>\nappears that the trial court while granting bail to the accused has<br \/>\ngone into the evidence in detail and has come to the conclusion that<br \/>\nprima facie no concrete reasons are made out not to grant bail to the<br \/>\naccused.  The trial court has observed that charge of offence under<br \/>\nsection 307 of IPC is prima facie doubtful and therefore the trial<br \/>\ncourt has considered that instead of leaving the accused languishing<br \/>\nin jail till the time the trial is over, they can be set out on bail<br \/>\non stringent terms and conditions.  The  accused do not seem to have<br \/>\nany antecedents and learned advocate for the applicant is not in a<br \/>\nposition to point out if the accused have committed breach of any<br \/>\nconditions imposed while granting bail.\n<\/p>\n<p>5.<br \/>\n In that view of the matter, this court is not inclined to cancel the<br \/>\nbail at this stage as no case is made out for the same.<br \/>\nApplication is accordingly rejected.\n<\/p>\n<p>(K.S.\n<\/p>\n<p>JHAVERI, J.)<\/p>\n<p>Divya\/\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Chandubhai vs State on 9 May, 2011 Author: Ks Jhaveri,&amp;Nbsp;
