DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Learned APP waives service of notice of Rule on behalf of<br \/>\nrespondent-State.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate for the applicant has submitted that in the backdrop of<br \/>\nallegations of preparing  a duplicate \/ forged or even bogus driving<br \/>\nlicense, for which, case may take substantially long time and the<br \/>\napplicant, who is having his photography studio can be considered for<br \/>\nregular bail by imposing suitable conditions. It<br \/>\nis further submitted that the applicant has roots in the society,<br \/>\nwill not flee from justice and will cooperate with the investigation<br \/>\nas and when called for.  It is further submitted that in view of the<br \/>\nabove, the applicant may be granted regular bail.\n<\/p>\n<p>3.\tConsidering<br \/>\nthe above prima facie aspects of the matter, I find this is a fit<br \/>\ncase to grant regular bail.  Under the circumstances, the applicant<br \/>\nis ordered to be released on bail in connection with CR NO.I-110 of<br \/>\n2011 registered with Pandesara Police Station on his furnishing bond<br \/>\nof Rs.5,000\/- (Rupees five thousand) with one surety of like amount<br \/>\nto the satisfaction of the lower Court and subject to following<br \/>\nconditions:\n<\/p>\n<p>a).\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b).\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c).\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>d).\tmark<br \/>\nhis presence before the concerned police station or every 1st<br \/>\nand 15th<br \/>\nday of English calender month between 11:00 a.m. and 2:00 p.m.<\/p>\n<p>e).\tnot<br \/>\nleave the state of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>f).\tfurnish<br \/>\nthe address of his residence at the time of executing of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>g).\tsurrender<br \/>\nhis passport, if any, to the Lower Court immediately.\n<\/p>\n<p>4.\tThe<br \/>\nauthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>5.\tIf<br \/>\nbreach of any of the above condition is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter.\n<\/p>\n<p>6.\tBail<br \/>\nbond to be executed before the Lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>7.\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>8.\tRule<br \/>\nis made absolute to the aforesaid extent.
