The following order was<br \/>\npassed on 23.3.2010.\n<\/p>\n<p>Order Date :- 2.4.2010 (F.H.)<\/p>\n<p><span class=\"hidden_text\">Court No. &#8211; 54<\/span><\/p>\n<p>Case :- APPLICATION U\/S 482 No. &#8211; 8719 of 2010<br \/>\nPetitioner :- Nahar Singh And Others<br \/>\nRespondent :- State Of U.P.And Another<br \/>\nPetitioner Counsel :- Arun Kumar Tiwari<br \/>\nRespondent Counsel :- Govt. Advocate<\/p>\n<p>&#8220;Hon&#8217;ble Ravindra Singh,J.\n<\/p>\n<p>Heard learned counsel for the applicants and learned A.G.A.<br \/>\nThis application has been filed with a prayer to quash the order dated<br \/>\n22.2.2010 passed by learned C.J.M., Kanpur Dehat in Misc. application<br \/>\nno. 1266 of 2009, whereby application under Section 153 (3) Cr.P.C.<br \/>\nhas been allowed.\n<\/p>\n<p>It is contended by the learned counsel for the applicants that the<br \/>\nimpugned order is illegal, it has not been passed in accordance with the<br \/>\nprovisions of law.\n<\/p>\n<p>It has been rebutted by the learned AGA by submitting that there is no<br \/>\nillegality in the impugned order because on the basis of the allegations<br \/>\nmade in the application under section 156(3) Cr.P.C., a prima facie<br \/>\ncognizable offence is made out and the allegations are of such nature<br \/>\nwhich requires investigation. There is no illegality in the impugned<br \/>\norder.\n<\/p>\n<p>Considering the submissions made by the learned counsel for the<br \/>\napplicants and the learned AGA and from the perusal of the application<br \/>\nunder section 156(3) Cr.P.C. It appears that on the basis of the<br \/>\nallegation made therein a prima facie cognizable offence is made out<br \/>\nand the allegations are of such a investigation is not suffering from any<br \/>\nillegality or irregularity, therefore, the prayer for quashing the<br \/>\nimpugned order is refused.\n<\/p>\n<p>It is further contended that the applicants is a man of peace living. He<br \/>\nshall cooperate with the investigating. In case, he is arrested and sent to<br \/>\njail during investigation, he shall suffer irreparable loss. Therefore, he<br \/>\nmay not be arrested during investigation.\n<\/p>\n<p> Considering the facts, circumstances of the case and the submissions<br \/>\nmade by the learned counsel for the applicants and the learned AGA, it<br \/>\nis directed that in case the F.I.R. has not been registered till today, if it<br \/>\nis lodged subsequently, in pursuance to the impugned order, the<br \/>\napplicant shall not be arrested during investigation of the case, but the<br \/>\napplicant shall cooperate with the investigation.<br \/>\nWith this direction, this application is finally disposed of.\n<\/p>\n<p>Order Date :- 2.4.2010 (F.H.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Nahar Singh And Others vs State Of U.P.And Another on 2 April, 2010 Hon&#8217;ble Ravindra Singh, J.
