Government Pleader, appearing for the appellant,<br \/>\n\tMr.R.J.Oza, learned advocate appearing for respondent No.1 and<br \/>\n\tMr.B.P.Tanna, learned Senior Counsel appearing on behalf of<br \/>\n\trespondent No.2.\n<\/p>\n<p>\tThe present Letters<br \/>\n\tPatent Appeal is filed by the appellants against the order and<br \/>\n\tjudgment passed by the learned Single Judge of this Court quashing<br \/>\n\tand setting aside the detention order dated 24.11.1999. The Court<br \/>\n\theld that the impugned order suffers from the vice of<br \/>\n\tnon-application of mind and that the issue of the detention order<br \/>\n\thas been withheld for considerable period. The Court further took<br \/>\n\tthe view that the detention order was for six months and it was<br \/>\n\tpassed on 24.11.1999. The petitioner was detained on 17.12.1999. The<br \/>\n\tpetitioner remained on parole from 27.12.1999 to 10.1.2000. He has<br \/>\n\tsuffered detention for 66 days. The Court, therefore, took the view<br \/>\n\tthat the petitioner should be released forthwith, if not required to<br \/>\n\tbe detained under any other order of detention for any other<br \/>\n\tcriminal case.\n<\/p>\n<p>\tSince the present appeal<br \/>\n\tchallenging the impugned order has become infructuous by efflux of<br \/>\n\ttime, we do not think it fit and proper to disturb the order passed<br \/>\n\tby the learned Single Judge. This Letters Patent Appeal is<br \/>\n\taccordingly dismissed as having become infructuous.\n<\/p>\n<p>         (K. A. PUJ, J.)
