The appellants have challenged the award of the<\/p>\n<p>learned Tribunal whereby compensation of Rs.5,53,000\/- has<\/p>\n<p>been awarded to the appellants.           The appellants seek<\/p>\n<p>enhancement of the award amount.\n<\/p>\n<p>2.    The accident dated 15th March, 1991 resulted in the<\/p>\n<p>death of Chander Mohan. The deceased was survived by his<\/p>\n<p>widow, son, two daughters and mother who filed the claim<\/p>\n<p>petition before the learned Tribunal.\n<\/p>\n<p>3.    The deceased was aged 40 years and five months at<\/p>\n<p>the time of the accident and was a Government Servant<\/p>\n<p>earning Rs.4,000\/- per month. The learned Tribunal took the<br \/>\n<span class=\"hidden_text\">FAO No.717\/2003                                    Page 1 of 4<\/span><br \/>\n future prospects into consideration and the income of the<\/p>\n<p>deceased after future prospects was taken at Rs.6,000\/- per<\/p>\n<p>month.        The learned Tribunal deducted 1\/3rd towards the<\/p>\n<p>personal expenses of the deceased and applied the multiplier<\/p>\n<p>of 11 to compute the loss of dependency at Rs.5,28,000\/-.<\/p>\n<p>The learned Tribunal has awarded Rs.10,000\/- towards<\/p>\n<p>funeral expenses and Rs.15,000\/- towards loss of consortium.<\/p>\n<p>The learned Tribunal has awarded total compensation of<\/p>\n<p>Rs.5,53,000\/- to the appellants.\n<\/p>\n<p>4.    The learned Senior Counsel for the appellants has<\/p>\n<p>urged the following grounds at the time of hearing of this<\/p>\n<p>appeal:-\n<\/p>\n<blockquote><p>      (i)      The multiplier be enhanced from 11 to 15.<\/p>\n<\/blockquote>\n<blockquote><p>      (ii)     The deduction towards the personal expenses of<\/p>\n<p>               the deceased be reduced from 1\/3rd to 1\/4th.<\/p>\n<\/blockquote>\n<blockquote><p>      (iii)    The compensation be awarded for loss of love and<\/p>\n<p>               affection and loss of estate.\n<\/p><\/blockquote>\n<p>5.    The Hon&#8217;ble Supreme Court in the case of Sarla Verma<\/p>\n<p>Vs. Delhi Transport Corporation, 2009 (6) Scale 129<\/p>\n<p>held the appropriate multiplier at the age of 40 years to be<\/p>\n<p>15 and the appropriate deduction towards the personal<\/p>\n<p>expenses to be 1\/4th where the deceased has left behind 4 to<\/p>\n<p>6 legal representatives.\n<\/p>\n<p>6.    Following      the   aforesaid   judgment of   the    Hon&#8217;ble<\/p>\n<p>Supreme Court, the multiplier is enhanced from 11 to 15 and<\/p>\n<p>the personal expenses are reduced from 1\/3rd to 1\/4th. The<br \/>\n<span class=\"hidden_text\">FAO No.717\/2003                                      Page 2 of 4<\/span><br \/>\n learned Tribunal has not awarded any compensation for loss<\/p>\n<p>of love and affection and loss of estate.      Rs.10,000\/- is<\/p>\n<p>awarded for loss of love and affection and Rs.10,000\/- is<\/p>\n<p>awarded for loss of estate.\n<\/p>\n<p>7.    Taking the income of the deceased to be Rs.6,000\/-, per<\/p>\n<p>month, deducting 1\/4th towards the personal expenses of the<\/p>\n<p>deceased, applying the multiplier of 15, adding Rs.15,000\/-<\/p>\n<p>for loss of consortium, Rs.10,000\/- for loss of love and<\/p>\n<p>affection, Rs.10,000\/- for loss of estate and Rs.10,000\/- for<\/p>\n<p>funeral expenses, the total compensation computed to be<\/p>\n<p>Rs.8,55,000\/-. [(Rs.6,000 X 12 X 3\/4 X 15) + Rs.15,000 +<\/p>\n<p>Rs.10,000 + Rs.10,000 + Rs.10,000)].\n<\/p>\n<p>8.    The appeal is allowed and the award amount is<\/p>\n<p>enhanced from Rs.5,53,000\/- to Rs.8,55,000\/-. The learned<\/p>\n<p>Tribunal has awarded interest @9% per annum which is not<\/p>\n<p>disturbed on the original award amount of Rs.5,53,000\/-.<\/p>\n<p>However, on the enhanced award amount, the rate of<\/p>\n<p>interest shall be @7.5% per annum from the date of filing of<\/p>\n<p>the petition till realization but the appellant shall not be<\/p>\n<p>entitled to any interest for 2\u00bd years in terms of the para 24<\/p>\n<p>of the award, which is not interfered in the peculiar facts of<\/p>\n<p>this case.\n<\/p>\n<p>9.    The enhanced award amount along with interest be<\/p>\n<p>deposited by respondent No.1 with UCO Bank, Delhi High<\/p>\n<p>Court Branch A\/c Sushma through Mr. M.M. Tandon, Member-<\/p>\n<p>Retail Team, UCO Bank Zonal, Parliament Street, New Delhi<br \/>\n<span class=\"hidden_text\">FAO No.717\/2003                                  Page 3 of 4<\/span><br \/>\n (Mobile No. 09310356400) within 30 days.<\/p>\n<p>10.   The order with respect to the disbursement of the<\/p>\n<p>award     amount   shall    be   passed   after    examining       the<\/p>\n<p>appellants who are directed to remain present in Court on<\/p>\n<p>the next date of hearing.\n<\/p>\n<p>11.   List for directions on 11th January, 2010.<\/p>\n<p>12.
