CIVIL WRIT PETITION NO.10010 OF<\/a> 2008\n\n\n\nDate of Order: 09th January, 2009\n\n                                        :::\n                                P R E S E N T\n\n                   HON'BLE MR JUSTICE GOVIND MATHUR\n\n\n\nMr Arjun Purohit, for the petitioner\n\n                                        :::\n\nBY THE COURT<\/pre>\n<p>       In    pursuance         to    advertisement        bearing     No.1\/09,<\/p>\n<p>petitioner         faced       the    process      of     selection    to    be<\/p>\n<p>recruited as Senior Secondary Recruit, however, his<\/p>\n<p>candidature         was    rejected        being    not    found    medically<\/p>\n<p>fit.    A    statutory         appeal      was   also     availed     ;by   the<\/p>\n<p>petitioner and that too came to be rejected. After<\/p>\n<p>rejection          of    the    appeal,       petitioner      got      himself<\/p>\n<p>medically examined by Dr KN Tiwari, Junior Specialist<\/p>\n<p>(Ear,       Nose     &amp;    Throat),      Babu       Ram    Bahadur     Memorial<\/p>\n<p>Hospital, Bharatpur and he declared him a person fit.<br \/>\n<span class=\"hidden_text\">                                                                                 2<\/span><\/p>\n<p>       Contention of the petitioner is that the Medical<\/p>\n<p>Board    of     the        Indian    Navy     while         considering       his<\/p>\n<p>candidature          for     recruitment          as       Senior    Secondary<\/p>\n<p>Recruit committed error and preference is required to<\/p>\n<p>be given to the opinion given by a senior Medical<\/p>\n<p>Practitioner. The petitioner has given challenge to<\/p>\n<p>condition prescribed in the procedure for selection<\/p>\n<p>that     the        opinion     given       by        any    other        medical<\/p>\n<p>practitioner except experts of Military Hospital shall<\/p>\n<p>not be accepted.\n<\/p>\n<\/p>\n<p>       Heard learned counsel for the petitioner.<\/p>\n<p>       The petitioner was examined by an Expert Committee<\/p>\n<p>of Doctors working in Military Hospital. His appeal<\/p>\n<p>was also considered by the experts and as such, I do<\/p>\n<p>not find any reason to interfere with that. Relevant<\/p>\n<p>to note that no allegation of malafides or extraneous<\/p>\n<p>consideration         against       the     Committee        of     experts    is<\/p>\n<p>made. A senior medical practitioner may have given an<\/p>\n<p>opinion contrary to experts of Military Hospital but<\/p>\n<p>that view is not at all relevant. Experts of Military<\/p>\n<p>Hospital       are    better        aware    of       criteria      and    needs<\/p>\n<p>required       to    enroll    a    person       in    a    force    as    Senior<\/p>\n<p>Secondary Recruit. The condition prescribed that no<\/p>\n<p>other    opinion       except       opinion       given      by     experts    of<\/p>\n<p>Military Hospital shall be accepted, is also having no<\/p>\n<p>irrationality as the experts of Military Hospital are<\/p>\n<p>better        equipped         and        better           aware     regarding<\/p>\n<p>requirements and needs for members of a Force.<br \/>\n<span class=\"hidden_text\">                                                        3<\/span><\/p>\n<p>      For the reasons mentioned above, I do not find any<\/p>\n<p>merit in this petition for writ.
