And others\n\n\n\n\n16.12.2010.\n\n       Shri Rohit Sohgaura, counsel for petitioner.\n       Shri P.K.Kaurav, Dy.A.G., for respondents .<\/pre>\n<p>       Heard on admission.\n<\/p>\n<p>       It is submitted by petitioner that identical matter was<br \/>\ndecided by a Division Bench of this Court in M\/s Zunaid<br \/>\nEnterprises &amp; others Vs. State of M.P. &amp; others                            in<br \/>\nW.P.No.16775\/2007 on 15.7.2010 and the writ petition was<br \/>\ndismissed, after considering the judgment of Apex Court in State<br \/>\nof Orissa and another Vs. K.B.Saha and sons Industries Pvt.<br \/>\nLtd., and others [(2007) 7 VST 214 (SC)]. Against the said order,<br \/>\npetitioners and others have filed Special Leave Petition before the<br \/>\nApex    Court,    which     has    been     registered     as   S.L.P.(Civil)<br \/>\nNo.25637\/2010, in which the Apex Court has issued notice to the<br \/>\nother side on 20.9.2010 and interim order has been passed. It is<br \/>\nsubmitted that this petition may be entertained and interim order<br \/>\nmay be passed in the matter.\n<\/p>\n<p>       Shri Kaurav, learned Dy.A.G., appearing for State opposed<br \/>\nthe aforesaid contention and submitted that the entire controversy<br \/>\nis covered by a Division Bench judgment of this Court in M\/s<br \/>\nZunaid Enterprises (supra), so this petition may not be<br \/>\nentertained.\n<\/p>\n<p>       Considering the fact that the Apex Court has entertained the<br \/>\npetition, notices have been issued and interim order has been<br \/>\npassed by the Apex Court, so we find it appropriate to entertain<br \/>\nthis writ petition, awaiting verdict from the Apex Court.\n<\/p>\n<p>       The Apex Court by order dated 20.9.2010 in S.L.P.(Civil)<br \/>\nNo.25637\/2010 directed thus :-\n<\/p>\n<blockquote><p>               &#8220;Issue notice.\n<\/p><\/blockquote>\n<blockquote><p>                Counsel appearing for the petitioners states<br \/>\n               that he had deposited 25% of the amount<br \/>\n               demanded and also furnished bank<br \/>\n               guarantee in terms of the order of the<br \/>\n                               W.P.No.10451\/2010<\/p>\n<p>          Anil Kumar Sultania                  State of M.P. And others<\/p>\n<p>                Division Bench of the Madhya Pradesh High<br \/>\n                Court. He shall keep the bank guarantee<br \/>\n                alive till the decision of this Court. No further<br \/>\n                coercive action shall be taken against<br \/>\n                petitioners in respect of the amount involved<br \/>\n                in the present case till the next date.&#8221;<\/p><\/blockquote>\n<p>          In view of aforesaid order, till next date of hearing, we direct<br \/>\nthus :-\n<\/p>\n<p>1.        Petitioner to deposit 25% of the amount demanded by the<br \/>\nrespondents.\n<\/p>\n<p>2.        Petitioner to further furnish bank guarantee of the remaining<br \/>\namount to the satisfaction of the authority and shall keep alive the<br \/>\nbank guarantee till further orders of this Court.\n<\/p>\n<p>3.        Both the parties are directed to mention this case as and<br \/>\nwhen the order dated 20.9.2010 is modified by the Apex Court or<br \/>\nthe S.L.P., is decided by the Apex Court.\n<\/p>\n<p>          In the meantime, respondents may file reply of this matter.<br \/>\n          Two extra copies of the petition may be served to the State<br \/>\nby the petitioner against acknowledgment.\n<\/p>\n<p>          C.C., as per rules.<\/p>\n<pre>\n\n\n\n          (Krishn Kumar Lahoti)                  (Smt.
