Nanavaty, learned Additional Public Prosecutor, waives<br \/>\nservice of Rule on behalf of respondents.\n<\/p>\n<p>2.<br \/>\n\tPresent application has been filed by the applicant-wife of the<br \/>\nconvict-prisoner Ashokbhai Parbhubhai Patel lodged at Central Jail,<br \/>\nVadodara for the grant of parole for the period of  30 days on the<br \/>\nground of several circumstances stated in the application.\n<\/p>\n<p>3.\tThe<br \/>\nconvict-prisoner has been convicted for the offence under Sections<br \/>\n143,144,148,147,341 and 302 of the Indian Penal Code by the Sessions<br \/>\nCourt, Navsari in Sessions Case No.88 of 1997 which has also been<br \/>\nconfirmed in Criminal Appeal No.567 of 2005 of this Court.\n<\/p>\n<p>4.\tThe<br \/>\napplicant wife has on yesterday moved urgently appearing as<br \/>\nparty-in-person and, therefore, learned Additional Public Prosecutor<br \/>\n    Mr.Nanavaty had requested to take instructions. He has placed on<br \/>\nrecord Jail Remarks Sheet and the impugned order passed by the<br \/>\nCollector, Vadodara dated 18.10.2010. Only reference was made to the<br \/>\neffect that due to the code of conduct application of Ashokbhai<br \/>\nParbhubhai Patel, lodged at Central Jail, Vadodara, cannot be<br \/>\nentertained and,  therefore, it is rejected. No other reasons are<br \/>\nassigned in the said order of the Collector dated 18.10.2010.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the applicant and learned Additional Public Prosecutor and<br \/>\nconsidering the present application as well as the Jail Remarks<br \/>\nSheet, the interest of justice would be served if the present<br \/>\napplication is allowed partly and the applicant is ordered to be<br \/>\nreleased for the period of 10 days on parole leave.\n<\/p>\n<p>6.\tAccordingly,<br \/>\nthe present application stands partly allowed.
