The claimants are the wife and\nchildren of the deceased. They have filed a claim petition u\/s 166\n\nof the Motor Vehicles Act claiming a sum of Rs.20,00,O00',l_f0ii':'}.n\n\naccount of the death of the deceased in an \n\noccurred at 6.00 am. on 20.08.2003 when he was.Vpruoceed.ing on\n\nBha.rwad--Kalghatagi road to go to Kadri \n\nmotorcycle bearing Reg. No.KA~25\/l.;9_l07.ll=The driver'.lAoif\"t'he hero \n\nhonda bearing Reg, No.KA-27\/J-73'?:5\"i.came\"   and\nnegligent manner and dasifzed agains\ufb02;thei'.._deceased\"\" and on\naccount of the same. the deceased  of ribs and\n\nright forearm, lower ,end 'wrist and:'V.\u00absucc'uije_bedli=to the injuries on\n\nthe spot.   up'\"foVrv\"consideration before 'the\nTribunal and 'then 0  \" assessing the oral and\ndocumentary evidence  rnaterial on the file allowed the\nsarne in awarding' of Rs.2,23,l84\/-- with interest at 6%\n\np.a._ fro:m,Vpetition till the date of realisation. The said\n\n cornpei1_satiori\" aI'w.ar'd:\"ed being inadequate the claimants are in\n\n0 \n\n    have heard learned counsel for the appellants and the\n\n' i.fiearr':edf counsel for the respondent--insurance company. After\n\n\u00ab~v~\"\"'\"\n..m-M-v\"\"\"M\n.a-*''\"\n\nl\n\n\n\ncareful pemsal of the impugned judgment what emerges is that on\naccount of the injury sustained in the accident the deceased died\n\non the spot on account of which the claimants have filed a claim\n\npetition contending that the deceased as drawing a \n\nRs.9,242\/- p.rn. Ex.P5 is the salary certi\ufb01cate produc:ed.V  it\n\nthe said salary if income tax and professio.na'l\u00bbtax are \n\nnet income of the petitioner would be   \n\nwhich if 1\/3 is deducted i.e.,  th'e,n.et \ncome to Rsi-\u20ac3,870\/-- pa. The deceased._wza.s 'aged. Sizyearsiand the\nproper multiplier to be apip\"lieid_,is,   reassess the\n\ncompensation for loss of depend--ency   as against\n\nRs.2,03,184\/aasesessed  the\"Tribuna'i';vvV-- \n\n4.
