Kuriakose, J<\/p>\n<p>      These appeals and cross objections pertain<\/p>\n<p>to acquisition of land in Kuthuparamba village for<\/p>\n<p>the purpose of construction of road leading from<\/p>\n<p>Palathinkara Junction on the Thalassery Coorg<\/p>\n<p>road to the Requisitioning Authority&#8217;s Industrial<\/p>\n<p>Growth Centre at Valiavelicham. The awarding<\/p>\n<p>officer under his award divided the entire property<\/p>\n<p>under acquisition into as many as five groups<\/p>\n<p>depending      upon      relative    distance      from<\/p>\n<p>Palathinkara junction. For properties in Group<\/p>\n<p>No.1, the properties situated in Palathinkara<\/p>\n<p>LAA.105\/10 &amp; con. cases       -2-\n<\/p>\n<\/p>\n<blockquote><p>     junction itself, he awarded land value at the rate<\/p>\n<p>     of Rs.9863\/- per cent. For properties included in<\/p>\n<p>     Group No.2, the property situated within a<\/p>\n<p>     distance of 1 kilometre from Palathinkara junction,<\/p>\n<p>     he awarded land value at the rate of Rs.6,499\/-<\/p>\n<p>     per cent. For properties included in Group No.3,<\/p>\n<p>     the properties situated within a distance of 1 to 2<\/p>\n<p>     kilometres from Palathinkara junction, the fixed<\/p>\n<p>     land value at the rate of Rs.3,899\/- per cent. For<\/p>\n<p>     properties included in Group No.4, i.e. the<\/p>\n<p>     properties situated within a distance of 2 to 3<\/p>\n<p>     kilometres from Palathinkara junction, he fixed<\/p>\n<p>     land value at the rate of Rs.2,387\/- per cent. For<\/p>\n<p>     properties included in Group No.5, the properties<\/p>\n<p>     situated within a distance of    3 to 6 kilometes<\/p>\n<p>     from Palathinkara, the Land Acquisition Officer<\/p>\n<p>LAA.105\/10 &amp; con. cases         -3-\n<\/p>\n<\/p>\n<blockquote><p>     awarded land value at the rate of Rs.2,148\/- per<\/p>\n<p>     cent.\n<\/p><\/blockquote>\n<blockquote><p>           2. In these cases in the first instance, the<\/p>\n<p>     Reference Court fixed the value at Rs.20,000\/- per<\/p>\n<p>     cent on the basis of evidence which came on<\/p>\n<p>     record. The Requisitioning Authority appealed<\/p>\n<p>     against that judgment and this Court remanded<\/p>\n<p>     the LAR cases for reconsideration in the light of<\/p>\n<p>     the judgment of this Court in K.S.I.D.C         v.<\/p><\/blockquote>\n<p>     Vayalambron Krishnan (2008(4) KLT 726). After<\/p>\n<p>     remand under the impugned judgment, the court<\/p>\n<p>     below      has    re-fixed  the market  value   at<\/p>\n<p>     Rs.13,400\/- per cent. In the appeals preferred by<\/p>\n<p>     the claimants they contend that the market value<\/p>\n<p>     re-fixed by the court is inadequate and while in<\/p>\n<p>     the memoranda of cross objection lodged by the<\/p>\n<p>LAA.105\/10 &amp; con. cases       -4-\n<\/p>\n<\/p>\n<blockquote><p>     Requisitioning Authority, it is contended that the<\/p>\n<p>     market value re-fixed by the court is grossly<\/p>\n<p>     inadequate.<\/p><\/blockquote>\n<p>           3. It was very extensive submissions which<\/p>\n<p>     was addressed before us by Sri.Joby Cyriac, the<\/p>\n<p>     learned counsel for the Requisitioning Authority<\/p>\n<p>     and Smt.R.Ranjini, the learned counsel for the<\/p>\n<p>     claimants. Sri.Joby Cyriac relying on the decision<\/p>\n<p>     of this Court in <a href=\"\/doc\/1266988\/\">K.S.I.D.C v. Vayalambron Krishnan<\/a><\/p>\n<p>     (2008(4) KLT 726) would argue that as the<\/p>\n<p>     properties under acquisition in these cases were<\/p>\n<p>     included by the Land Acquisition Officer in Group<\/p>\n<p>     No.3, the claimant cannot aspire for more than<\/p>\n<p>     Rs.9,000\/- per cent which was the value finally<\/p>\n<p>     fixed by this Court in that judgment. Smt.Ranjini,<\/p>\n<p>     however, would argue that though the acquired<\/p>\n<p>LAA.105\/10 &amp; con. cases        -5-\n<\/p>\n<\/p>\n<blockquote><p>     properties were included by the Land Acquisition<\/p>\n<p>     Officer in Group No.3, the evidence will reveal that<\/p>\n<p>     the properties are eligible to be included in Group<\/p>\n<p>     No.1 itself. It was taking into account that aspect<\/p>\n<p>     of the matter that the court below re-fixed the<\/p>\n<p>     value at the present rate. According to her, once it<\/p>\n<p>     is recognized that the properties are eligible to be<\/p>\n<p>     included in Group No.1, the properties will have to<\/p>\n<p>     be awarded much higher value than what is<\/p>\n<p>     presently awarded. She argued that the court<\/p>\n<p>     below has found that these properties are eligible<\/p>\n<p>     to be included in Group No.1. She highlighted<\/p>\n<p>     before us the last two sentences in paragraph<\/p>\n<p>     No.23 of the impugned judgment.\n<\/p><\/blockquote>\n<blockquote><p>                  &#8220;The properties were acquired for<br \/>\n           the purpose of widening of the road<br \/>\n           leading to Industrial Growth Centre,<\/p>\n<p>LAA.105\/10 &amp; con. cases       -6-\n<\/p><\/blockquote>\n<blockquote><p>           Mooriyad, in five reaches. The acquired<br \/>\n           properties come within the first reach<br \/>\n           which is nearby to Kuthuparamba town.<br \/>\n           The total length of the road is about 8<br \/>\n           kms.&#8221;<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           4. We have very anxiously considered the<\/p>\n<p>     rival submissions addressed at the Bar. We have<\/p>\n<p>     made a reappraisal of the evidence. We have<\/p>\n<p>     scanned the impugned judgment. At the outset,<\/p>\n<p>     we will notice that the submission of Smt.Ranjini<\/p>\n<p>     that the court below has found under the<\/p>\n<p>     impugned judgment that these properties were<\/p>\n<p>     eligible to be included in the Group No.1 is not<\/p>\n<p>     correct. In fact, in the portion of the judgment<\/p>\n<p>     highlighted before us by Smt.Ranjini, the learned<\/p>\n<p>     Subordinate Judge was only referring to the<\/p>\n<p>     arguments put forth on behalf of the claimants.<\/p><\/blockquote>\n<p>           5. By the judgment of this Court in K.S.I.D.C<\/p>\n<p>LAA.105\/10 &amp; con. cases       -7-\n<\/p>\n<\/p>\n<blockquote><p>     v. Vayalambron Krishnan (2008(4) KLT 726) this<\/p>\n<p>     Court decided that the correct market value to be<\/p>\n<p>     awarded for the properties in that case which was<\/p>\n<p>     included in Group No.3 and awarded land value at<\/p>\n<p>     the rate of Rs.3,899\/- per cent was Rs.9,000\/- per<\/p>\n<p>     cent. But the evidence in this case will clearly<\/p>\n<p>     show that the properties under acquisition were<\/p>\n<p>     situated within a distance of less than one<\/p>\n<p>     kilometre from Palathinkara junction. This means<\/p>\n<p>     that we find force in the submission of Smt.Ranjini<\/p>\n<p>     that the properties under acquisition were eligible<\/p>\n<p>     to be included in a superior category i.e. Group<\/p>\n<p>     No.2. For properties in Group No.2, the Land<\/p>\n<p>     Acquisition Officer had awarded value at the rate<\/p>\n<p>     of Rs.6499\/- per cent. We are of the considered<\/p>\n<p><span class=\"hidden_text\">     view that as the properties in Group Nos.1, 3, 4<\/span><\/p>\n<p>LAA.105\/10 &amp; con. cases         -8-\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>     and 5 were lying contiguously and continuously in<\/p>\n<p>     the same village there is co-relation between the<\/p>\n<p>     respective values. In fact, the Land Acquisition<\/p>\n<p>     Officer also has maintained the ratio between the<\/p>\n<p>     values of these five properties. According to us,<\/p>\n<p>     any enhancement in the value of properties<\/p>\n<p>     included in a particular group should necessarily<\/p>\n<p>     result in enhancement in the value of properties in<\/p>\n<p>     the other groups also. Under the judgment in<\/p>\n<p>     <a href=\"\/doc\/1266988\/\">K.S.I.D.C      v. Vayalambron Krishnan<\/a> (2008(4) KLT<\/p>\n<\/blockquote>\n<blockquote><p>     726) this Court has re-fixed the value of land for<\/p>\n<p>     which the Land Acquisition Officer has awarded<\/p>\n<p>     Rs.3,839\/- per cent at Rs.9,000\/- per cent,<\/p>\n<p>     thereby giving 130% increase over what was<\/p>\n<p>     awarded. In view of our finding that the properties<\/p>\n<p>     under acquisition in this case are eligible to be<\/p>\n<p>LAA.105\/10 &amp; con. cases         -9-\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>     included in Group No.2 it will have to be found<\/p>\n<p>     further that the correct market value of the<\/p>\n<p>     properties under acquisition should be at least<\/p>\n<p>     Rs.14,947\/- per cent which we round off to<\/p>\n<p>     Rs.15,000\/- per cent. Accordingly, we re-fix the<\/p>\n<p>     market value of the land under acquisition at<\/p>\n<p>     Rs.15,000\/- per cent. All these appeals are<\/p>\n<p>     allowed and all these Cross Objections are<\/p>\n<p>     dismissed. Parties are directed to suffer their<\/p>\n<p>     respective costs. Claimants will be entitled for all<\/p>\n<p>     statutory benefits admissible under Sections 23<\/p>\n<p>     (2), 23(1A) and under Section 28 of the Land<\/p>\n<p>     Acquisition Act.<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           6. It is clarified that we have not decided by<\/p>\n<p>     this judgment that properties in each group<\/p>\n<p>     (Group Nos.1, 4 and 5 also) are eligible for<\/p>\n<p>LAA.105\/10 &amp; con. cases    -10-\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>     enhancement at 130%.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                PIUS C.
