 lpublic interest litigation is filed for a direction<\/p>\n
 to: respondents 1 and 2 to remove unlawful obstruction<\/p>\n
\/W3<\/p>\n
and encroachment and to remove public nuisance<\/p>\n
caused by respondents herein, after holding <\/p>\n
The petitioners have also sought for  ~<\/p>\n
respondents 3 to 6 from causing .an},r_laWful’v”obst.ruc4tio1’2,_ ll’<\/p>\n
and\/ or public nuisance in   <\/p>\n
including unlawful crem_atioIlr0If burial it as ” it<\/p>\n
the case may be.\n<\/p>\n
2. According  Sy.No.8 of
\nBandigere j1__(rn.%Qj\u00a2}\u20ac   Hobli. and
\n measuring 5 acres
\n12 gun_tas_ dmeant for Grave Yard since<\/p>\n
time immemorial _.”\ufb02*i’he”.\u00bbisaid Grave Yard is being used<\/p>\n
 by  niembersof Brahmin Community of 5 Villages,<\/p>\n
 \u00bbn:a;rr_1VeiyV,  *A.,gBasavapura, Venkataiahana Chatra,<\/p>\n
  V V S Ankanashettypura Village and<\/p>\n
  There is no other place available for<\/p>\n
A C_*p:eri’orI1iai’1ce of the said religious obsequies ceremonies<\/p>\n
‘  of the community in the said villages. A bore well is<\/p>\n
to<\/p>\n
also dug in the said property to provide water for<\/p>\n
performing the obsequies ceremonies on the <\/p>\n
3. Respondents are the owners <\/p>\n
adjoining the said Sy.No.8  <\/p>\n
According to the petitioners,’ respondents 3:..i;o’:6 <\/p>\n
encroaching Sy.No.8 though’V’Vit\u00bbV.:._i’s  rrreant for
\nGrave Yard; that   Hhandedly
\nand illegally sought    a gate to
\nobstruct diet. 4′ ‘~.\/grave Yard. The
\npetitioners   jurisdictional police
\nand   “dead bodies had to be<\/p>\n
crernatedzp Cvopiesilpofcomplaints are produced at<\/p>\n
 Anrierrures-Oi.’ 8., dated 20.7.1998 and 12.8.1998<\/p>\n
‘reenectiv.el,.”~–. So also re resentations as er<\/p>\n
1’  and U, dated 20.7.1998, 12.8.1998 and<\/p>\n
  respectively are filed by the petitioners before<\/p>\n
A  lthe~._concerned authorities. Ultimately, the second<\/p>\n
responderit appointed a Surveyor to make spot survey<\/p>\n
be<\/p>\n

and to report. The copy of the survey sketch is
\nproduced at Annexure–V. In spite of the complaints and
\nthe representations, no action is taken. Hence, <\/p>\n
petition is filed.\n<\/p>\n
4. Having regard to the material  record,  is, it<\/p>\n
clear that the grievance of the peatitionetrs  <\/p>\n
that the representations\/ conipiaintsvh are not considered ‘V<\/p>\n
by the concerned authoritieseffectively. Itfthey land in
\nquestion is reserved as a Grave” tiii\u00e9 ‘Syame will have<\/p>\n
to be protected’so’_.’– ‘.3-.  if they have no<\/p>\n

 question’. The’–Grays Yard has to be maintained for<\/p>\n

Coriiniissiojner shall consider the representations filed<\/p>\n
 by  petitioners and initiate action in accordance with<\/p>\n
