     First         defendant         in         O.S.315\/1985         is         the<\/p>\n
appellant.   Respondents   1   to   6   are   the   plaintiffs<\/p>\n
and   the   other   respondents   the   other   defendants.\n<\/p>\n
Suit  was  filed  for  partition  and  separation  of  the<\/p>\n
shares   of   the   plaintiffs.     The   property   sought   to<\/p>\n
be   partitioned   is   the   property   obtained   by   Ibrahim<\/p>\n
under   Ext.A1   marupat,   which   was   bequeathed   by<\/p>\n
Ibrahim   under   Ext.B1   will.     Item   No.1   therein   is<\/p>\n
the   plaint   schedule   property.   It   is   the     property<\/p>\n
which        was   covered   under   Ext.A1   marupat.   The<\/p>\n
property   is   available   for   partition   was   not<\/p>\n
disputed by any of the parties.  The dispute at the<\/p>\n
time   of   trial   was   with   regard   to   the   special<\/p>\n
rights,   because   of   the   covenants   in   Ext.B1   Will,<\/p>\n
which   according   to   plaintiffs   is   binding   and   which<\/p>\n
according  to  defendants  is  not  binding.    The  trial<\/p>\n
court   found   that   covenants   are   not   binding   and<\/p>\n

entire   1.24   acres   in   R.S.No.77\/1   consisting   of<\/p>\n
plots   A,   B   and   D   in   Ext.C1   plan   are   to   be   divided<\/p>\n
into   six   equal   shares   and   plaintiffs   are   to   be<\/p>\n
allotted   two   shares.   The   decree   and   judgment   were<\/p>\n
challenged          before         Sub              Court,         Payyannur         in<\/p>\n
A.S.87\/1988   by   plaintiffs   in   A.S.87\/1988   and   first<\/p>\n
defendant   in   A.S.79\/1989.     Learned   single   Judge<\/p>\n
dismissed   A.S.79\/1989   holding   that   the   convenants<\/p>\n
in   Ext.B1   Will   are   not   valid   and   the   property   is<\/p>\n
available   for   partition.     A.S.87\/1988   was   allowed<\/p>\n
modifying the preliminary decree to the effect that<\/p>\n
the property available for partition is plots A and<\/p>\n
C   in   Ext.C1   plan.     First   defendant   is   challenging<\/p>\n
the   modified   preliminary   decree   in   the   second<\/p>\n
appeal.\n<\/p>\n
      2.   The   real   dispute   between   the   parties   was<\/p>\n
with  regard  to  the  actual  identity  and  location  of<\/p>\n
the   property   to   be   divided.     There   is   no   dispute<\/p>\n
with   regard   to   the   shares.     Commissioner   submitted<\/p>\n
Ext.C2  report  and  C1  plan.    Commissioner  has  shown<\/p>\n
plaint   schedule   property   as   plots   A   to   F.     The<\/p>\n

Commissioner     identified   plot   A   as   the   property<\/p>\n
covered   under   Ext.A1   marupat.     Ext.C1   report   shows<\/p>\n
that   when     Commissioner   inspected   the   property,<\/p>\n
both plaintiffs and defendants admitted that plot B<\/p>\n
which lies to the north of   plot A is also part of<\/p>\n
the     property covered under Ext.A1 marupat and is<\/p>\n
available   for   partition.             So   also   when   the<\/p>\n
Commissioner inspected the property , 5th  plaintiff<\/p>\n
who   was   examined   as   PW1   on   behalf   of   all   the<\/p>\n
plaintiffs,   submitted   before   the   Commissioner   that<\/p>\n
plot   D   which   lies   to   the   west   of   the   rainwater<\/p>\n
channel  is  also  available  for  partition  as  part  of<\/p>\n
Ext.A1   property.     It   is   on   that   basis   the   trial<\/p>\n
court   granted   a   decree   for   partition   of   plot   A,   B<\/p>\n
and   D.     The   Appellate   Court   excluded   plot   B   and   D<\/p>\n
from   the   property   to   be   divided   on   the   basis   that<\/p>\n
Commissioner   identified   only   plot   A   and   C   as   the<\/p>\n
property  covered  under  Ext.A1  and  B1.    The  dispute<\/p>\n
is   whether   the   identification   made   by   the<\/p>\n
Commissioner   is   correct   and   whether   the   property<\/p>\n
which lies to the east namely , plot D, plot E and<\/p>\n

plot   F   are   properties   obtained   by   Ibrahim   under<\/p>\n
Ext.A1   marupat   and   bequeathed   under   Ext.B1.\n<\/p>\n
Plaintiffs   contended   that   the   property   which   lies<\/p>\n
to   the   east   of   the   property   covered   under   Ext.A1<\/p>\n
and   B1   were   obtained   by   Kannan   Nair   under   Ext.A3<\/p>\n
marupat and was later assigned in favour of Moideen<\/p>\n
and was purchased by the father   Mammad and   under<\/p>\n
Ext.A7   purchase   certificate   was   also   obtained     and<\/p>\n
therefore   the   said   property   is   not   available   for<\/p>\n
partition.\n<\/p>\n
      3.The argument of learned counsel appearing for<\/p>\n
appellant  is  that  the  property  is  to  be  identified<\/p>\n
not   with   reference   to   the   extent   or   kole<\/p>\n
measurement   but   with   regard   to   the   boundaries   and<\/p>\n
if  so  identified,  the  entire  plots  A,B,C,D,E  and  F<\/p>\n
forms   part   of   the   property   obtained   under   Ext.A1.\n<\/p>\n
Learned   counsel   appearing   for     respondents   argued<\/p>\n
that   the   Commissioner        identified   the   property<\/p>\n
correctly and therefore only plot A   is   available<\/p>\n
for partition.\n<\/p>\n
      4.   On   hearing   learned   counsel   appearing   for<\/p>\n

appellant   and   respondents,   it   is   clear   that   there<\/p>\n
is   no   dispute   with   regard   to   the   availability   of<\/p>\n
Ext.A1   property   which   was   later     bequeathed   under<\/p>\n
Ext.B1,   for   partition   among   the   plaintiffs   and<\/p>\n
defendants.     The   extent   available   for   partition<\/p>\n
need   not   be   decided   in   the   preliminary   decree,   as<\/p>\n
that   is   a   question   which   can   be     decided   in   the<\/p>\n
final   decree.     Therefore   interest   of   justice   will<\/p>\n
be met, if the finding of  courts below with regard<\/p>\n
to the extent of the property to be divided is set<\/p>\n
aside and that question is left open to be decided<\/p>\n
in the final decree application.   It is made clear<\/p>\n
that in the final decree application,  Court has to<\/p>\n
fix   the   property   obtained   under   Ext.A1   which   was<\/p>\n
bequeathed   as   item   No.1   under   Ext.B1.               The<\/p>\n
identification   of   the   property   shall   not   be<\/p>\n
restricted   to        the   kole   measurements.          While<\/p>\n
identifying   the   property,   the   boundaries   cannot   be<\/p>\n
ignored.   The court has also to decide whether the<\/p>\n
property claimed for division forms part of Exts.A3<\/p>\n
and   A4.        After   fixing   the   actual   extent,<\/p>\n

properties are to be divided in accordance with the<\/p>\n
preliminary decree.\n<\/p>\n
      Second   appeal   is   therefore   allowed   in   part.\n<\/p>\n
The   preliminary   decree   passed   by     learned   Munsiff<\/p>\n
and   confirmed   by   learned     Sub   Judge   are   confirmed<\/p>\n
subject         to   the   following   modification.                         The<\/p>\n
property   available   for   partition   is   the   property<\/p>\n
covered   under   Ext.A1   marupat   and   bequeathed   under<\/p>\n
item   No.1   of     Ext.B1   Will.     In   the   final   decree<\/p>\n
application          the         exact         identity,         extent         and<\/p>\n
location   of   the   property   is   to   be   fixed   as   stated<\/p>\n
earlier.    Thereafter  the  property  is  to  be  divided<\/p>\n
into   six   equal   shares   as   provided   in   the<\/p>\n
preliminary decree.\n<\/p>\n
