Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :19\/02\/2007\n\n O R D E R\n               THOTTATHIL B.RADHAKRISHNAN, J\n\n                       -------------------------------------------\n\n                         W.P(C).No.20506 OF 2006\n\n                       -------------------------------------------\n\n               Dated this the 19th day of February, 2007\n\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>       The petitioner is the  widow and the third respondent is the<\/p>\n<p>father of deceased R.Suresh, who was employed with the Kerala<\/p>\n<p>State   Electricity   Board.     The   first   respondent   Tahsildar   issued<\/p>\n<p>Ext.P3   heirship   certificate   showing   the   petitioner   and   the   third<\/p>\n<p>respondent as  heirs  of  late   Suresh.   This  is under challenge  by<\/p>\n<p>the   widow.     According   to   her,   she   is   the   only   surviving   class   I<\/p>\n<p>heir   of   Suresh   under   the   Hindu   Succession   Act,   his   mother<\/p>\n<p>having   predeceased   him.     Learned   counsel   appearing   for   the<\/p>\n<p>third respondent contends that though the third respondent, the<\/p>\n<p>father of Suresh,  is only a class II heir, Ext.P3 certificate cannot<\/p>\n<p>be   found   fault   with   because   the   Tahsildar   was   justified   in<\/p>\n<p>including the father of the deceased also as an heir since the said<\/p>\n<p>person is an heir, at least a class II heir.  So much so, Ext.P3 may<\/p>\n<p>be gospel truth.  But the fact remains that priority in terms of the<\/p>\n<p>provisions of the Hindu Succession Act enjoins that class I heirs<\/p>\n<p>WPC.20506\/06<\/p>\n<p>                                   Page numbers<\/p>\n<p>will inherit in preference to class II heirs, while there would be<\/p>\n<p>equal   distribution   among   class   I   heirs   and   in   their   absence,<\/p>\n<p>among the class II heirs.     So much so, though the father is   an<\/p>\n<p>heir   in   class   II,   since   the   petitioner,   the   widow,   is   admittedly<\/p>\n<p>alive, she alone will succeed to the testator of late Suresh.   The<\/p>\n<p>right of parties to succession may be an issue for the civil courts<\/p>\n<p>to decide.   But Ext.P3, as it stands, would only create confusion<\/p>\n<p>and lead to much undesired litigation.\n<\/p>\n<\/p>\n<p>         Under   such   circumstances,     it   is   hereby   directed   that<\/p>\n<p>though Ext.P3 shows the third respondent as also a heir, it shall<\/p>\n<p>be   treated   as   one   issued   recognising   the   petitioner   as   the   sole<\/p>\n<p>heir   at   law,   entitled   to   inherit   the   estate   of   late   R.Suresh   in<\/p>\n<p>preference   to   the   third   respondent,   father.
