Justice R.BASANT\n\n Dated :15\/02\/2008\n\n O R D E R\n                               R.BASANT, J.\n\n                            ----------------------\n\n                             B.A.No.909  of 2008\n\n                        ----------------------------------------\n\n             Dated this  the  15th day of February 2008\n\n\n                                   O R D E R\n<\/pre>\n<p>      Application   for   anticipatory   bail.     The   petitioners   face<\/p>\n<p>allegations   in   a   crime   registered   alleging   offences   punishable<\/p>\n<p>inter   alia   under   Section   308   I.P.C.     One   of   the   co-accused,   the<\/p>\n<p>third accused, who faces identical allegations like the petitioners<\/p>\n<p>have already been granted anticipatory bail by this court as per<\/p>\n<p>Annexure   1   order   dated   4\/2\/2008   in   B.A.No.641\/2008.     I   have<\/p>\n<p>adverted to facts in detail in the order dated 04\/02\/2008 referred<\/p>\n<p>above.  It is not necessary for me to advert to facts in any greater<\/p>\n<p>detail in this order.\n<\/p>\n<p>      2.     The   learned   counsel   for   the   petitioners   prays,   the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer and I<\/p>\n<p>am satisfied that the petitioners can be granted anticipatory bail<\/p>\n<p>subject   to   identical   conditions   as   were   imposed   on   the   co-\n<\/p>\n<p>accused.\n<\/p>\n<p>      3.     In   the   result,   this   petition   is   allowed   in   part.\n<\/p>\n<p>Following   directions   are   issued   under   Section   438   Cr.P.C   in<\/p>\n<p>favour of the petitioners.\n<\/p>\n<p>      i)     Petitioners   shall   surrender   before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on   22\/02\/2008.     They<\/p>\n<p><span class=\"hidden_text\">B.A.No.909\/08                             2<\/span><\/p>\n<p>may file  application  for  regular bail after  giving  sufficient  prior<\/p>\n<p>notice   to   the   learned   Prosecutor   in   charge   of   the   case.\n<\/p>\n<p>Appropriate   orders   shall   be   passed   by   the   learned   Magistrate<\/p>\n<p>expeditiously   on   the   application   of   the   petitioner   and   on   any<\/p>\n<p>other   application,   which   the   police   may   file,   and   pass<\/p>\n<p>appropriate   orders   thereon.
