NO. 30252 OF 2010 F\n              ------------------------------------------------------\n              Dated this the 4th day of October, 2010\n\n\n                                 JUDGMENT\n<\/pre>\n<p>       The petitioner is the Manager of Koorikkuzhi A.M.U.P.School,<\/p>\n<p>Kaipamangalam. It is stated that one day verification of the student<\/p>\n<p>strength for 2009-10 was made on 14.7.2009 and thereafter, high<\/p>\n<p>level verification was also held. In the one day verification, according<\/p>\n<p>to the petitioner,the educational officer omitted to note that 68 private<\/p>\n<p>study students were there in the School. On the basis of the one day<\/p>\n<p>verification, it is stated that instead of 24 class divisions, only 18<\/p>\n<p>divisions were sanctioned for 2009-10. Challenging non-grant of six<\/p>\n<p>posts of LPSA\/UPSA, the petitioner preferred appeal before the<\/p>\n<p>Deputy Director of Education.           The appeal was rejected as per<\/p>\n<p>Ext.P5 order dated 30.3.2010.              Challenging Ext.P5 order, the<\/p>\n<p>petitioner has filed Ext.P6 statutory appeal before the Government.<\/p>\n<p>Ext.P6 is pending disposal.\n<\/p>\n<\/p>\n<p>       2. The reliefs prayed for in the Writ Petition are the following:<\/p>\n<p>W.P.(C) NO.30252 OF 2010<\/p>\n<p>                                      :: 2 ::\n<\/p>\n<p>       &#8220;(i)   call for the records relating to Exhibits P2 and P5<\/p>\n<p>              and quash the originals of the same by the issue<\/p>\n<p>              to the extent they exclude 68 students towards<\/p>\n<p>              the staff fixation order of a writ of certiorari or<\/p>\n<p>              other appropriate writ or order.\n<\/p>\n<\/p>\n<p>       (ii)   issue a writ of mandamus or other appropriate<\/p>\n<p>              writ   order    or   direction   commanding     the<\/p>\n<p>              Department to revise the staff fixation order by<\/p>\n<p>              reckoning those 68 students who are excluded<\/p>\n<p>              from consideration.\n<\/p>\n<\/p>\n<p>       (iii)  issue a writ of mandamus or other appropriate<\/p>\n<p>              writ order or direction commanding the 1st<\/p>\n<p>              Respondent to effectively consider and pass<\/p>\n<p>              appropriate orders upon Exhibit P6 after affording<\/p>\n<p>              an opportunity of being heard to the Petitioner<\/p>\n<p>              within a time limit.\n<\/p>\n<\/p>\n<p>       (iv)   pass such other order or direction which this<\/p>\n<p>              Hon&#8217;ble Court may deem fit and proper to grant in<\/p>\n<p>              the circumstances of the case.&#8221;\n<\/p>\n<\/p>\n<p>       3. The learned counsel for the petitioner submits that, for the<\/p>\n<p>time being, it is sufficient if Ext.P6 is directed to be disposed of by<\/p>\n<p>the first respondent.\n<\/p>\n<p>W.P.(C) NO.30252 OF 2010<\/p>\n<p>                                     :: 3 ::\n<\/p>\n<p>      Since Ext.P6 appeal is pending before the Government, I do<\/p>\n<p>not think that it is proper to consider the contentions of the petitioner<\/p>\n<p>on the merits.
