This writ petition has been filed by the petitioner<\/p>\n<p>                   challenging order dated 13.06.2007 passed by Certificate Officer,<\/p>\n<p>                   Bhagalpur (respondent no.2) in Certificate Case No.15 of 2006-07<\/p>\n<p>                   issuing Warrant of Arrest and also for direction to the said<\/p>\n<p>                   respondent to dispose of the objection of the petitioner dated<\/p>\n<p>                   20.03.2007 and for other ancillary reliefs.\n<\/p>\n<p>                             3. Short substance of the matter is that notice under<\/p>\n<p>                   section 7 of the Bihar and Orissa Demand Recovery Act, 1914<\/p>\n<p>                   (hereafter referred to as the Act for the sake of brevity) was issued<\/p>\n<p>                   by the Certificate Officer on the petitioner as certificate debtor,<\/p>\n<p>                   whereafter the petitioner filed his reply denying his liability under<\/p>\n<p>                   section 9 of the Act. The petitioner has annexed entire order sheet of<\/p>\n<p>                   the aforesaid Certificate Case No.15 of 2006-07 which shows that<\/p>\n<p>                   the said objection was never decided and in the meantime order<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>         dated 13.06.2007 was passed issuing Warrant of Arrest against the<\/p>\n<p>         petitioner.\n<\/p>\n<p>                   4. This appears against the specific provisions of law as it<\/p>\n<p>         was the duty of the said authority to first decide the objection under<\/p>\n<p>         section 9 of the Act after hearing under section 10 of the Act and<\/p>\n<p>         only thereafter such steps for issuance of Warrant of Arrest etc.<\/p>\n<p>         could have been legally taken.\n<\/p>\n<p>                   5. In the said circumstances, the impugned order dated<\/p>\n<p>         13.06.2007 passed in Certificate Case No.15 of 2006-07 issuing<\/p>\n<p>         Warrant of Arrest against the petitioner is hereby quashed and the<\/p>\n<p>         Certificate Officer, Bhagalpur (respondent no.2) is directed to<\/p>\n<p>         proceed with Certificate Case No.15 of 2006-07                and take<\/p>\n<p>         appropriate steps against the petitioner in accordance with law only<\/p>\n<p>         after passing an order under section 10 of the Act deciding the<\/p>\n<p>         objection filed by the petitioner under section 9 of the Act. The<\/p>\n<p>         petitioner must appear in the said proceeding on each and every date<\/p>\n<p>         fixed by Certificate Officer, Bhagalpur (respondent no.2). It may be<\/p>\n<p>         noted that this court has not considered the legality or otherwise of<\/p>\n<p>         the objection filed by the petitioner.\n<\/p>\n<p>                   6.
