Hence, the appellant had<br \/>\n\tpreferred application for restoration of the said suit. However,<br \/>\n\tduring pendency of the said suit, as there was no interim<br \/>\n\tinjunction, the appellant herein filed application Exhibit 10 for<br \/>\n\tinterim injunction, which ultimately came to be rejected vide<br \/>\n\timpugned order dated 07th July 2010. Hence, present<br \/>\n\tappeal.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocates for the respective parties.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned advocates for the<br \/>\n\trespective parties, contentions raised in the appeal and on perusal<br \/>\n\tof the impugned order, it transpires that the trial Court has<br \/>\n\trejected the said application Exhibit on the ground of delay.<br \/>\n\tHowever, the ultimately conclusion arrived at by the trial Court<br \/>\n\tseems to just and proper in view of the fact that application<br \/>\n\tExhibit 10 for interim injunction is not maintainable at all as the<br \/>\n\tsuit has been disposed of and the same has not been restored till<br \/>\n\tdate. So far as the contention of the learned advocate for the<br \/>\n\tappellant that the trial Court ought to have exercised powers under<br \/>\n\tSection 151 of the Code of Civil Procedure, 1908 is concerned, it is<br \/>\n\tpertinent to note that when the suit has already been disposed of,<br \/>\n\tthere is no question of exercise of powers under Section 151 of the<br \/>\n\tCode. Thus, the trial Court has rightly not entertained the<br \/>\n\tapplication Exhibit 10.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid, I am of the opinion that the view taken by the<br \/>\n\ttrial Court is just and proper. Over and above aforesaid reasons, I<br \/>\n\tadopt the reasons assigned by the trial Court. No case is made out<br \/>\n\tto interfere with the conclusion arrived at by the trial Court.<br \/>\n\tHence, present appeal deserves to be dismissed.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, present appeal fails and is, accordingly,<br \/>\n\tdismissed.
