Bobde, J.)<\/p>\n<p>    .            Heard learned counsel for the parties.\n<\/p>\n<p>    2.           The    petitioners      have challenged the           Order<\/p>\n<p>    dated    27.12.2007       passed by the Chief          Minister         of<\/p>\n<p>    Maharashtra          cancelling      the      Development          Right<\/p>\n<p>    Certificate          granted     by        the   Pune        Municipal<\/p>\n<p>    Corporation in favour of the petitioners and further<\/p>\n<p>    directing       the    Pune Municipal Corporation to               grant<\/p>\n<p>    TDR   in      the    petitioners favour at the rate               of    4%<\/p>\n<p><span class=\"hidden_text\">                                                      ::: Downloaded on &#8211; 09\/06\/2013 14:08:18 :::<\/span><br \/>\n<span class=\"hidden_text\">                                    :3:<\/span><\/p>\n<p>    instead of 100% granted earlier.                 The subject matter<\/p>\n<p>    of    the    dispute      is    land bearing        Final      Plot       No.<\/p>\n<p>    517(Part) and Final Plot No.                523(Part) situate in a<\/p>\n<p>    Town    Planning Scheme and reserved for the                     purposes<\/p>\n<p>    of    a park.      The land is shown in the Hill Top                    Hill<\/p>\n<p>    Slope       Zone    as    per      the    last     Development          Plan<\/p>\n<p>    sanctioned        for    the city of Pune in the year                 1987.\n<\/p>\n<pre>    The area is 66,732 sq.             meters.\n\n\n\n\n                                            \n    3.          The    petitioners,        being owners of the              said\n\n<\/pre>\n<p>    land which was acquired by the Municipal Corporation<\/p>\n<p>    of Pune, applied to the Corporation for grant of TDR<\/p>\n<p>    under the Development Control Rules.                  The respondent<\/p>\n<p>    No.3        Corporation          issued        Development            Right<\/p>\n<p>    Certificate bearing Nos.              3434-3447 in favour of the<\/p>\n<p>    petitioners        granting 100% TDR admeasuring 66,372.82<\/p>\n<p>    sq.     meters on 28.5.2004.             The petitioners is             said<\/p>\n<p>    to    have    paid an amount of           Rs.50,12,316\/-           towards<\/p>\n<p>    construction        of    a compound wall          for    construction<\/p>\n<p>    protection.\n<\/p>\n<p>    4.          Apparently,        the grant made in favour of the<\/p>\n<p>    petitioners        and some others were questioned in                     the<\/p>\n<p>    State Legislative Assembly and the Government stayed<\/p>\n<p>    implementation          of   the     TDR.      A    Public       Interest<\/p>\n<p>    Litigation        No.    113 of 2004 was filed in this Court<\/p>\n<p><span class=\"hidden_text\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 14:08:18 :::<\/span><br \/>\n<span class=\"hidden_text\">                                    :4:<\/span><\/p>\n<p>    challenging        the grant of TDR at the rate of 1.00 to<\/p>\n<p>    the    petitioners.          That petition was disposed of                  on<\/p>\n<p>    27.4.2005      recording that there was already a                      stay.\n<\/p>\n<p>    Since    the petitioners were aggrieved by the stay or<\/p>\n<p>    injunction        they    filed Writ Petition No.                 5939      of<\/p>\n<p>    2006.    This petition was disposed of on 15.1.2007 by<\/p>\n<p>    an    Order of this Court directing the petitioners to<\/p>\n<p>    make    a    representation          to the      respondent         No.2      &#8211;\n<\/p>\n<p>    Secretary      Government          of Maharashtra and a             further<\/p>\n<p>    direction         to    the    respondent         No.2     to     pass      an<\/p>\n<p>    appropriate         order.         The     Court     granted        interim<\/p>\n<p>    protection<\/p>\n<p>                      to the petitioners that in the meanwhile<\/p>\n<p>    they     may      not    deposit         the     Development           Right<\/p>\n<p>    Certificates with the Government.\n<\/p>\n<p>    5.          On 13.3.2007, the Chief Minister, Government<\/p>\n<p>    of    Maharashtra        heard      the petitioners as            well      as<\/p>\n<p>    others who had objection to the grant of 100% TDR to<\/p>\n<p>    the petitioners.          The Chief Minister passed an order<\/p>\n<p>    dated 27.12.2007 holding that the TDR on the land in<\/p>\n<p>    question       shall         be    4%     having     regard       to       the<\/p>\n<p>    predominant use of Hill Top Hill Slope Zone on which<\/p>\n<p>    the land is situate and its reservation as a Park.\n<\/p>\n<p>    6.          The    learned        counsel      for   the    petitioners<\/p>\n<p>    submits      that      the    Order of the Chief           Minister         is<\/p>\n<p><span class=\"hidden_text\">                                                          ::: Downloaded on &#8211; 09\/06\/2013 14:08:18 :::<\/span><br \/>\n<span class=\"hidden_text\">                                      :5:<\/span><\/p>\n<p>    illegal       in       that    the Government is       estopped           from<\/p>\n<p>    reducing       the TDR having once granted it.                   According<\/p>\n<p>    to     the    petitioners         the land is       surrounded         by     a<\/p>\n<p>    residential area and therefore the land in question,<\/p>\n<p>    which     may      be     in No Development         Zone,     should        be<\/p>\n<p>    treated       as eligible for the same TDR for which land<\/p>\n<p>    in residential zone is available.\n<\/p>\n<p>    7.           We    are     unable      to    accept   either        of     the<\/p>\n<p>    contentions            raised    on behalf of       the    petitioners.<\/p>\n<pre>\n\n    There     seems         to be a little doubt that the land                  is\n\n    reserved       for\n                              \n                             the purposes of a park.\n                             \n    8.           D.C.R.       No.    N-2.4.5 reads as follows:-\n\n\n\n<\/pre>\n<p>                 &#8220;The built up area for the purpose of FSI<\/p>\n<p>                 credit in the form of a DRC shall be equal<br \/>\n                 to the gross area of the reserved plot that<\/p>\n<p>                 is surrendered and     will proportionately<br \/>\n                 increase   or decrease    according to the<br \/>\n                 permissible FSI of the zone where from the<br \/>\n                 TDR has originated.&#8221;\n<\/p>\n<p>    Thus    the       FSI    of the Zone from where            the      TDR     is<\/p>\n<p>    originates         affects      the proportionate          increase         or<\/p>\n<p>    decrease          of     FSI    when        the   reserved      plot        is<\/p>\n<p>    surrendered.\n<\/p>\n<p>                 DCR NO.      M-8 reads as follows:\n<\/p>\n<p><span class=\"hidden_text\">                                                          ::: Downloaded on &#8211; 09\/06\/2013 14:08:18 :::<\/span><br \/>\n<span class=\"hidden_text\">                                  :6:<\/span><\/p>\n<p>               &#8220;Hills and hill slopes zone<\/p>\n<p>               Swimming Pools \/ Sports and Games, Health<\/p>\n<p>               Clubs, Cafeteria &#8211; Canteen, Amusement Park<br \/>\n               etc.\n<\/p>\n<p>               Note:   Maximum floor space area shall not<br \/>\n               exceed 4% of the total plot with ground<br \/>\n               floor structure without stilts.&#8221;\n<\/p>\n<p>    It    is clear from the above that for the land                   which<\/p>\n<p>    is    situate    in the Hills and Hill Slopes              Zone       the<\/p>\n<p>    maximum    floor     space area cannot exceed 4%               of     the<\/p>\n<p>    total    plot    with    ground floor structure.               In     the<\/p>\n<p>    circumstances<\/p>\n<p>                         there can be no question of estoppel.\n<\/p>\n<p>    9 .       We    find    no    reason to interfere          with       the<\/p>\n<p>    Order of the Government which holds that the land is<\/p>\n<p>    in a Hill Top and Hill Slope area with more than 1:5<\/p>\n<p>    steep    slope.      This character of the land              has      not<\/p>\n<p>    undergone      any   change     even    though      it     has      been<\/p>\n<p>    reserved    for a park in the Town Planning Scheme                     of<\/p>\n<p>    1987.    The TDR in respect of such a land is 4%.                     The<\/p>\n<p>    consequent       cancellation      of     Development             Right<\/p>\n<p>    Certificates      granting      100% TDR is   correct           having<\/p>\n<p>    regard    to    DCR No.      N-2.4.5.
