Vehicle has been recovered at the instance of the petitioners but from an open place. Learned counsel submitted that petitioners are in jail since 16\/6\/2010. Learned counsel submits that there are four more cases pending against petitioner No.2-Jarnel Singh whereas, there is only one case against petitioner No.1-Girraj Singh and they may be granted bail particularly when the investigation is still pending.\n<\/p>\n<p>\t\tLearned Public Prosecutor has opposed the bail application.\n<\/p>\n<p>\t\tLearned counsel for petitioners sought permission of this Court to withdraw the bail application of petitioner No.2-Jarnel Singh with liberty to apply for bail after challan is filed.\n<\/p>\n<p>\t\tConsequently, this bail application u\/S.439 Cr.P.C. of petitioner No.2-Jarnel Singh is dismissed as withdrawn with liberty to apply for bail after challan is filed.\n<\/p>\n<p>\t\tHaving regard to the facts aforesaid and considering all other facts and circumstances of the case, I deem it just and proper to enlarge petitioner No.1-Girraj Singh on bail.\n<\/p>\n<p>\t\tIn the result, this bail application of u\/S.439 Cr.P.C. of petitioner No.1 is allowed and it is directed that petitioner No.1  Girraj Singh S\/o Shri Deedar Singh shall be released on bail in FIR No.100\/2010 P.S.
