Secretary, Home &amp; Another\nPetitioner Counsel :- Raza Zaheer\nRespondent Counsel :- G.A.\n\nHon'ble Rajiv Sharma,J.\n<\/pre>\n<p>Hon&#8217;ble Raj Mani Chauhan,J.\n<\/p>\n<p>Heard learned counsel for the petitioners and learned A.G.A. for the State as<br \/>\nwell as perused the record.\n<\/p>\n<p>This writ petition under Article 226 of the Constitution of India has been filed<br \/>\nby the petitioners for quashing the impugned First Information Report dated<br \/>\n06.7.2010 at Crime No. 295 of 2010, under Section 2\/3 (i) U.P. Gangster and<br \/>\nAnti Social Activities (Prevention) Act, 1986 registered at Police Station<br \/>\nMotigarpur, District Sultanpur and also for direction to the opposite parties<br \/>\nnot to arrest them in pursuance of the said impugned First Information Report.\n<\/p>\n<p>We have gone through the contents of the First Information Report which<br \/>\ndisclose the commission of cognizable offence as such it cannot be quashed.\n<\/p>\n<p>The Writ Petition is, therefore, dismissed.\n<\/p>\n<p>However, keeping in view the facts of the case, it is provided that in case, the<br \/>\npetitioners appear before the court below and moves any application for bail<br \/>\nthe same will be disposed of by the court below expeditiously preferably on<br \/>\nthe same day.\n<\/p>\n<p>Order Date :- 12.8.2010<br \/>\nSantosh\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Siraj Khan &amp; Others vs State Of U.P., Thru.
