Justice K.HEMA\n\n Dated :15\/06\/2010\n\n O R D E R\n                             K.HEMA, J.\n                          ------------------\n                       B.A. No. 3322 of 2010\n                 ------------------------------------\n               Dated this the 15th day of June, 2010\n\n                             O R D E R\n<\/pre>\n<p>       Petition for bail.\n<\/p>\n<p>      2. The alleged offence is under Section 302 of the Indian<\/p>\n<p>Penal Code.      According to prosecution,       petitioner and the<\/p>\n<p>deceased are relatives. The deceased was picking cashew nuts<\/p>\n<p>from his property, while the petitioner went to him and inflicted<\/p>\n<p>grievous injury with a chopper and he died consequent to the<\/p>\n<p>injury.\n<\/p>\n<p>      3. Learned counsel for petitioner submitted that there is a<\/p>\n<p>civil dispute between the parties and the property where incident<\/p>\n<p>happened is disputed property. Petitioner is in the custody on<\/p>\n<p>02.04.2010, the investigation is almost over and there is no<\/p>\n<p>chance of absconding, it is submitted.<\/p>\n<p>      4. This is the second application for bail. Learned counsel<\/p>\n<p>for petitioner submitted that petitioner is in custody for the past<\/p>\n<p>74 days. Learned Public Prosecutor submitted that no objection<\/p>\n<p>for granting bail, but stringent conditions may be imposed, it is<\/p>\n<p>submitted.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3322 of 2010                2<\/span><\/p>\n<p>      5. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted on conditions. Hence the following order is passed:<\/p>\n<blockquote><p>                 Petitioner shall be released on bail on his<\/p>\n<p>          executing a bond for Rs.50,000\/- with two solvent<\/p>\n<p>          sureties each for the like sum to the satisfaction of<\/p>\n<p>          the Magistrate Court concerned on the following<\/p>\n<p>          conditions:<\/p>\n<blockquote><p>               i)      Petitioner   shall   report   before    the<br \/>\n                     Investigating Officer on every Monday and<br \/>\n                     Thursday, between 10 A.M. and 1 P.M.,<br \/>\n                     until further orders.\n<\/p><\/blockquote>\n<blockquote><p>               ii)     Petitioner shall not enter the limits of the<br \/>\n                     police station within which the crime is<br \/>\n                     registered,   except    for  compliance     of<br \/>\n                     condition no.1, until further orders.\n<\/p><\/blockquote>\n<blockquote><p>               iii)   Petitioner shall not influence or intimidate<br \/>\n                     any witness or tamper with the evidence.\n<\/p><\/blockquote>\n<\/blockquote>\n<p>         This petition is allowed.<\/p>\n<p>                                          K.
