OFFICER AND ANOTHER \n\n \n\nVersus\n \n\nJESHABHAI\nTIRKAMBHAI \n\n \n\n==========================================Appearance\n: \nMR RC KODEKAR, Assistant Government Pleader\nfor the Appellants  \nMR AJ PATEL\nfor the Defendants  \n==========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BHAGWATI PRASAD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/07\/2008 \n\n \n\nCOMMON\nORAL JUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nfiling these appeals under Section 54 of the Land Acquisition Act,<br \/>\n1894 (\u00fdSthe Act\u00fd\u00fd for  short)  read with Section 96 of the Civil<br \/>\nProcedure Code, 1908, the appellants have challenged the legality of<br \/>\ncommon judgment and award dated 31.03.2006 rendered by the learned<br \/>\n4th Additional Senior Civil Judge, Ahmedabad (Rural) at<br \/>\nNavrangpura, in Land Acquisition Case Nos. 354 of 1999, 356 to 366 of<br \/>\n1999 and 369 of 1999 whereby the claimants have been awarded<br \/>\nadditional amount of compensation at the rate of Rs.24.00 per Sq.Mtr.<br \/>\nfor their acquired lands over and above the compensation offered to<br \/>\nthem by the Special Land Acquisition Officer at the rate of Rs.0.70<br \/>\npaise and Rs.1.05 paise per  Sq.Mtr. by his award dated 20.03.1998.\n<\/p>\n<p>2.\tThe<br \/>\n Executive Engineer, Narmada Project, Saurashtra Branch Canal,<br \/>\nDivision No.2\/6, Botad proposed to the State Government to acquire<br \/>\nthe lands of village Keriya, Taluka Dhandhuka, District Ahmedabad for<br \/>\nthe public purpose of construction of Narmada Canal. On perusal of<br \/>\nthe said proposal, the State Government was satisfied that the lands<br \/>\nmentioned in the said proposal were likely to be needed for the<br \/>\npublic purpose. Therefore, a notification under Section 4 of the Act<br \/>\nwas issued, which was published in the Official Gazette on<br \/>\n04.09.1995. Thereafter, necessary inquiry was conducted under Section<br \/>\n5A(2) of the Act. On the basis of the report submitted by the Special<br \/>\nLand Acquisition Officer, declaration under Section 6 of the Act was<br \/>\nmade, which was published in the Official Gazette on 31.08.1996.<br \/>\nThe interested persons were  thereafter served with the notices for<br \/>\ndetermination of compensation payable to them. The claimants appeared<br \/>\nbefore the Special Land Acquisition Officer and claimed compensation<br \/>\nat the rate of Rs.50\/- per Sq.Mtr. for their agricultural land.<br \/>\nHowever, the Special Land Acquisition Officer, by his award dated<br \/>\n20.03.1998, offered compensation to the claimants at the rate of<br \/>\nRs.0.70 paise and Rs.1.05 paise per Sq.Mtr. The claimants were of the<br \/>\nopinion that the offer of compensation made by the Special Land<br \/>\nAcquisition Officer was totally inadequate.  Therefore, the claimants<br \/>\nsubmitted applications under Section 18 of the Act requiring the Land<br \/>\nAcquisition Officer to refer their cases to the Court for the purpose<br \/>\nof determination of just amount of compensation payable to them.<br \/>\nAccordingly, the references were made to the District Court,<br \/>\nAhmedabad, where they were registered as Land Acquisition Cases<br \/>\nreferred to hereinabove.\n<\/p>\n<p>3.\tOn<br \/>\nbehalf of the claimants, Shri Jagabhai Rupabhai was examined at<br \/>\nExh.38.  The witness has deposed that the lands in question were<br \/>\nacquired for the purpose of Narmada Project and the lands of the<br \/>\nclaimants are situated adjoining to each other. The witness has<br \/>\ndeposed  that all the acquired lands are equal and fertile land and<br \/>\nhaving irrigation facilities by wells and bore-wells. It is also<br \/>\nstated by this witness that the village has milk society,<br \/>\nco-operative societies, post office, primary school, pucca road,<br \/>\ntelephone facilities, etc. The witness has also deposed that the<br \/>\nclaimants are taking two-three crops and earning net agricultural<br \/>\nincome of Rs.40,000\/- per vigha per year. It is further stated<br \/>\nby the witness that the lands of adjoining  village Dharpipla were<br \/>\nacquired earlier  for the said purpose pursuant to notification<br \/>\nissued under Section 4 of the Act on 23.07.1984 wherein the Reference<br \/>\nCourt, by its judgment and award  dated 27.01.1997 rendered in L.A.<br \/>\nCase Nos. 72 to 101 of 1989, awarded total compensation at the rate<br \/>\nof Rs.12.50 paise per Sq.Mtr. Though  this witness was cross-examined<br \/>\nby the other side, nothing substantial could be brought on record.\n<\/p>\n<p>\tOn<br \/>\nbehalf of the appellants, Shirishbhai Kantibhai Vakhariya  was<br \/>\nexamined at Exh.50.  He has deposed that he was with the division<br \/>\nsince five years and had seen the lands of the village. In his<br \/>\ncross-examination, this witness has admitted that he has no personal<br \/>\nknowledge about acquisition. It is also admitted by this witness that<br \/>\nin village Dharpipla  and village Keriya, same crops are possible and<br \/>\nthat one another canal is passing through village Keriya.\n<\/p>\n<p>4.\tOn<br \/>\nthe basis of the evidence adduced by the parties, the Reference Court<br \/>\nwas of the opinion that the previous award of the Reference Court<br \/>\nrelating to the lands of village Dharpipla  rended in Land<br \/>\nAcquisition Case Nos. 72 of 1989 to 101 of 1989 (Exhibit 36)  was a<br \/>\nrelevant piece of evidence for the purpose of determining the market<br \/>\nvalue of the lands acquired in the present case.  The Reference Court<br \/>\n noticed that notification under Section 4(1) of the Act was<br \/>\npublished in the Official Gazette on 23.07.1984 for  acquiring the<br \/>\nlands of village Dharpipla whereas in the instant case it was<br \/>\npublished in the Official Gazette on 04.09.1995 and as there was time<br \/>\ngap  about 11 years, the claimants were entitled to reasonable rise<br \/>\nin price of lands at the rate of 10% per annum.  In the ultimate<br \/>\nanalysis, the Reference Court has awarded additional amount of<br \/>\ncompensation at the rate of Rs.24\/- per Sq.Mtr.  to the claimants by<br \/>\nthe impugned award, which has given rise to the present appeals.\n<\/p>\n<p>5.\tHeard<br \/>\nthe learned advocates for the parties. This Court has perused the<br \/>\njudgment of the Reference Court and other relevant evidence adduced<br \/>\nby the parties before  the Reference Court.\n<\/p>\n<p>6.\tFrom<br \/>\nthe record of the case, it appears that the claimants have never<br \/>\nclaimed enhanced  compensation either on the yield  basis or<br \/>\ncomparable sale instances. What was relied upon by the claimants was<br \/>\nprevious award of the Reference  Court relating to the lands of<br \/>\nvillage  Dharpipla (Exhibit 36).  It is also reported that the award<br \/>\nExhibit 36 in respect of the lands of village Dharpipla is accepted<br \/>\nby the  Government and the amount is also paid. From the evidence, it<br \/>\nappears that the lands of both the villages, i.e. Dharpipla and<br \/>\nKeriya are adjoining to each other and there is minor  distance<br \/>\namongst them. It is also evident that fertility of the lands of both<br \/>\nthe villages is similar. It is well settled  that previous award of<br \/>\nthe Reference Court relating to a village, which has attained<br \/>\nfinality can be considered to be a good piece of evidence for the<br \/>\npurpose of determining the market value of similar lands acquired<br \/>\nsubsequently from the adjoining village.   As stated above, the award<br \/>\nof the Reference Court relating to the lands of adjoining village<br \/>\nDharpipla  has attained finality. Therefore,  this Court is of the<br \/>\nopinion that no error was committed by the Reference Court in placing<br \/>\nreliance on the previous award of the Reference Court for the purpose<br \/>\nof determining the market value of the lands acquired in the instant<br \/>\ncase and giving 10% rise per year.  On re-appreciation of the<br \/>\nevidence adduced before the Reference Court, this Court is of the<br \/>\nview  that the finding recorded by the Reference Court that the<br \/>\nclaimants are entitled to enhanced compensation on the basis of<br \/>\nprevious award of the Reference Court relating to the lands of<br \/>\nadjoining village cannot  be interfered  with and deserves to be<br \/>\nupheld.\n<\/p>\n<p>7.\tIn<br \/>\nview of the aforesaid discussion, the appeals deserve to be dismissed<br \/>\nand are accordingly dismissed. The impugned judgment and award of the<br \/>\nReference Court is hereby confirmed. There shall be no orders.
