[251G-252A]\n     (2)  In the facts and circumstances of the case,  there\nis  no need to set  aside the judgment of the High Court  at\nthe instance of the appellants.\t They are, given liberty  to\nfile  a review petition before the High Court.\t The  review\npetition,  if filed, shall be entertained by the High  Court\nand  the appellants given a hearing as if the  matters\twere\nheard afresh as far as they are concerned.  It is  clarified\nthat  the  review application will not be  confined  to\t the\nnormal grounds on which a review can be sought but\n\t\t\t\t\t\t       251\nthe  entire controversy will be regarded as open as  between\nthe appellants and the respondents. Pilli for the Applicant.\n<\/p>\n<p>     The Judgment of the Court was delivered by<br \/>\n     KANIA,  J.\t This  Special Leave  Petition\tis  directed<br \/>\nagainst\t   the judgment\t of  a\tDivision   Bench   of\t the<br \/>\nBombay\t  High\t  Court\t  in   Writ Petition No.   4497\t  of<br \/>\n1990.  The  High  Court\t allowed  the  said  writ   petition<br \/>\nand\tstruck\t  down\t  a    communication\tfrom\t the<br \/>\nBombay\t Municipal Corporation.\t respondent  no.  2  herein,<br \/>\ninforming   the\t petitioners  in   the said  writ  petition,<br \/>\nwho  are  arrayed  as  respondents  nos.  3  to\t 13   before<br \/>\nus,    that   their   application   for\t   permission\t  to<br \/>\ndevelop\t   the\t property, namely,  the\t land  in   question<br \/>\nsituated  at  Village\tBalkum\t near\tThane, was  rejected<br \/>\nin   view   of\tthe  representations  submitted\t   to\t the<br \/>\nGovernment   by\t  the\towners\t of    chemical\t   factories<br \/>\nsituated    in\t  the\t said\tvillage,   who\t  are\t the<br \/>\nappellants\/petitioners\t   herein    that    no\t    building<br \/>\nconstruction  permission   should  be\tgranted\t  within   a<br \/>\ncertain\t   distance   from    the    said   factories.\t The<br \/>\npetitioners in\tthe  Special  Leave  Petition  are  some  of<br \/>\nthe said  chemical  factories.\tThey  were  not\t joined\t  in<br \/>\nthe  writ  petition  as respondents  and  have\tprayed\t for<br \/>\nleave\tto   file  the\tSpecial\t Leave\t Petition   on\t the<br \/>\nground\t that  the  judgment  adversely\t affects  them\t and<br \/>\nthey are aggrieved by the same.\n<\/p>\n<p>     Permission is granted. Leave is granted. Counsel heard.<br \/>\n     We\t find that appellants can be  said  to\tbe   parties<br \/>\naggrieved  by  the impugned  judgment,\teven  if  they\t are<br \/>\nnot  regarded  as  necessary   parties<br \/>\n<span class=\"hidden_text\">\t\t\t\t\t\t       252<\/span><br \/>\nin the writ petition.  In the facts and circumstances of the<br \/>\ncase,  we  find\t that  there is no need\t to  set  aside\t the<br \/>\nimpugned  judgment of the Bombay High Court at the  instance<br \/>\nof  the\t appellants.   The appellants  are.  however,  given<br \/>\nliberty\t to  file a review petition before the\tBombay\tHigh<br \/>\nCourt  for reviewing the impugned judgment, within a  period<br \/>\nof  four  weeks from today. 9 In our opinion, it  is  proper<br \/>\nthat  the entire controversy to which the  judgment  relates<br \/>\nshould\tbe determined in the light of the submissions  which<br \/>\nmay be made by the appellants.\n<\/p>\n<p>     In\t these\tcircumstances,\twe direct  that\t the  review<br \/>\npetition, if filed, shall be entertained by the Bombay\tHigh<br \/>\nCourt  and the appellants will be given a hearing as if\t the<br \/>\nmatter\twere heard afresh as far as they are concerned.\t  It<br \/>\nis clarified that the hearing of the review application will<br \/>\nnot be confined to the normal grounds on which a review\t can<br \/>\nbe  sought  but the entire controversy will be\tregarded  as<br \/>\nopen as between the appellants herein and the respondents.<br \/>\n    The interim order made by this Court on January 8,\t1991<br \/>\nwill  continue\tto  remain  in\toperation  till\t the  review<br \/>\npetition is decided by the High Court.\tHowever, it will  be<br \/>\nopen for the High Court to vary or vacate the interim  order<br \/>\non appropriate applications made to it by any of the parties<br \/>\nor  by any of the interveners here.  If the review  petition<br \/>\nis  not\t filed\twithin the said period of  four\t weeks,\t the<br \/>\nappeal\tshall stand dismissed and all interim orders  passed<br \/>\nby us shall be deemed to be vacated.\n<\/p>\n<p>     In\t our  opinion, the review petition  deserves  to  be<br \/>\ndisposed of with expedition and we would, therefore, request<br \/>\nthe  High Court to dispose of the review petition, if  filed<br \/>\nas  aforestated,  within four months from today and  in\t any<br \/>\nevent, by the 30th September, 1991.\n<\/p>\n<p>     The  matter  shall now be placed before  learned  Chief<br \/>\nJustice\t of  the Bombay High Court for\tpassing\t appropriate<br \/>\ndirections.\n<\/p>\n<p>     The appeal is disposed of as aforestated with no  order<br \/>\nas to costs.\n<\/p>\n<pre>V.P.R.\t\t\t\t     Appeal  disposed\tof.\n<span class=\"hidden_text\">\t\t\t\t\t\t       253<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Bayer (India) Ltd.
