Justice M.SASIDHARAN NAMBIAR\n\n Dated :15\/11\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n             W.P.C.NO.6854 OF 2010\n           ---------------------------------------------\n           Dated 15th November, 2010\n\n\n                         JUDGMENT\n<\/pre>\n<p>          Petition is filed                        under Article<\/p>\n<p>226  of   Constitution                 of        India    for  a<\/p>\n<p>direction  to       the        fourth            respondent    to<\/p>\n<p>complete  the        investigation                   into  Ext.P4<\/p>\n<p>petition, in view of Ext.P5 judgment in<\/p>\n<p>W.P.C.8115\/2009. By Ext.P5 judgment this<\/p>\n<p>court directed the District Superintendent<\/p>\n<p>of  Police,    Kottayam             to       consider      Ext.P4<\/p>\n<p>petition filed therein, within one month<\/p>\n<p>and petitioners were directed to produce<\/p>\n<p>copy of the judgment along with copy of the<\/p>\n<p>writ petition before the fourth respondent.<\/p>\n<p>According to the petitioners, though Ext.P6<\/p>\n<p>statements    were           recorded,                no  further<\/p>\n<p>development was        known to them. Ext.P4 is a<\/p>\n<p>Wpc 6854\/10<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>representation made by the petitioners before<\/p>\n<p>the Director General of Police, for a detailed<\/p>\n<p>investigation     with regard  to    a   complaint<\/p>\n<p>filed by them before Sub Inspector of Police,<\/p>\n<p>Melukavu Police Station on 9\/2\/2009 alleging<\/p>\n<p>that they were attacked by first respondent on<\/p>\n<p>21\/1\/2009 at about 8.30 p.m. By Ext.P5 judgment<\/p>\n<p>this Court did not direct     registration of the<\/p>\n<p>case.      Petitioners  did   not   approach   the<\/p>\n<p>concerned Magistrate under Section 156(3) of<\/p>\n<p>Code of Criminal Procedure to get the case<\/p>\n<p>registered and investigated.<\/p>\n<p>           2. Learned Government Pleader submitted<\/p>\n<p>that      pursuant  to Ext.P5   judgment,   Ext.P4<\/p>\n<p>complaint was enquired into and it was revealed<\/p>\n<p>that no      offence as alleged was committed. In<\/p>\n<p>such circumstances, writ petition is disposed<\/p>\n<p>directing fourth respondent to intimate        the<\/p>\n<p>Wpc 6854\/10<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>petitioners,  the  result  of  the  enquiry  on<\/p>\n<p>Ext.P4 complaint within thirty days    from the<\/p>\n<p>date of receipt of a copy of this judgment.
