\/6\/   27 April 2011                   Heard the counsel for the appellant and the<\/p>\n
                          State.\n<\/p>\n
                                      The learned counsel for the appellant placed the<\/p>\n
                          copies of depositions etc. and on this basis it appeared that<\/p>\n
                          the appeal is fit to be taken up on merit with the consent of<\/p>\n
                          the other side. The appeal has been taken up on merit and<\/p>\n
                          is being disposed off. The lower Court’s record has also<\/p>\n
                          been received.\n<\/p>\n
                                      The appellant has been convicted under<\/p>\n
                          Sections 302 of the Indian Penal Code and had been
\n                 2<\/span><\/p>\n
sentenced to undergo rigorous imprisonment for life. He<\/p>\n
was, further, convicted under Section 27 of the Arms Act<\/p>\n
and was sentenced to undergo rigorous imprisonment for<\/p>\n
three years. The judgment of conviction and sentence was<\/p>\n
passed on 16th April, 2010, by the Additional Sessions<\/p>\n
Judge, XI, Saran at Chapra, in S.T. No. 24 of 2009. The<\/p>\n
sentences were directed to run concurrently. The fardbeyan<\/p>\n
of P.W. 7, Jagjiwan Paswan, was the basis of the<\/p>\n
prosecution case.    According to Jagjiwan Paswan on<\/p>\n
16.12.2007 at 07.00 p.m. his son, deceased, Santosh<\/p>\n
Kumar, aged about 20 years was basking the fire in front of<\/p>\n
the house. At that time Pankaj Kumar Singh, the appellant,<\/p>\n
aged about 19 years, was also basking fire. Suddenly, the<\/p>\n
appellant got annoyed with Santosh Kumar upon which<\/p>\n
Santosh Kumar wanted to run away, but, the appellant took<\/p>\n
up pistol and fired causing instantaneous death of Santosh<\/p>\n
Kumar. Initially appellant and the deceased were friends.<\/p>\n
The occurrence was witnessed by P.W. 2, Banti Kumar<\/p>\n
Paswan, P.W. 3, Kalawati Devi, wife of the informant,<\/p>\n
Jagjiwan Paswan, and P.W. 4, Kalawati Devi, wife of Raj<\/p>\n
Kumar, and Bahoo of P.W. 7, Jagjiwan Paswan, who were<\/p>\n
present at the time of occurrence. The fardbeyan was
\n                  3<\/span><\/p>\n
entered into and registered as Dariyapur P.S. Case No. 102<\/p>\n
of 2007 on 17.12.2007 against the sole appellant under<\/p>\n
Sections 302 of the Indian Penal Code and 27 of the Arms<\/p>\n
Act.   The case was investigated into, charge sheet was<\/p>\n
submitted, cognizance was taken and the case was<\/p>\n
committed to the Court of sessions where the charge sheet<\/p>\n
under Sections 302 of the Indian Penal Code and 27 of the<\/p>\n
Arms Act was framed.\n<\/p>\n
            The plea of innocence was taken by the sole<\/p>\n
accused\/appellant. His, further, defence was that the father<\/p>\n
of Santosh Kumar has not attributed any immediate cause<\/p>\n
or motive of the occurrence and so there was possibility<\/p>\n
and the implication with a view to ulterior motive.<\/p>\n
            The trial Court after considering the defence<\/p>\n
and after hearing the parties subsequently convicted and<\/p>\n
sentenced the appellant.\n<\/p>\n
            In order to prove the case, prosecution has<\/p>\n
examined P.W. 1, Durgesh Paswan, P.W. 2, Banti Paswan,<\/p>\n
P.W. 3, Kalawati Devi, wife of the informant, Jagjiwan<\/p>\n
Paswan, P.W. 4, Kalawati Devi, wife of Raj Kumar Prasad<\/p>\n
and aunt of the deceased, Santosh Kumar, P.W. 5, Gupta<\/p>\n
Paswan, P.W. 6, Ramji Pandit, P.W. 7, Jagjiwan Paswan,
\n                     4<\/span><\/p>\n
the informant, P.W. 8, Dularchand Prasad, P.W. 9 Hareram<\/p>\n
Singh, P.W. 10 Madan Singh, P.W. 11, Rafik Ahmad Kha,<\/p>\n
the investigating officer, and P.W. 12, the doctor who has<\/p>\n
conducted the post mortem examination and prepared the<\/p>\n
post mortem examination report (exhibit 8). The doctor<\/p>\n
has found the following ante mortem injuries on the body<\/p>\n
of the deceased :\n<\/p>\n
            “External injury :-<\/p>\n
            (i)         One lacerated with black chard margin
\n                        oval in shape \u00bd” x \u00bd” in size cavity deep
\n                        with margin inverted present at posterior
\n                        surface of left chest wall is would of
\n                        entry.\n<\/p><\/blockquote>\n
            (ii)        One oval lacerated wound of size 1″ x 1″\n<\/p><\/blockquote>\n
                        in diameter with margin extruded on
\n                        middle of posterior chest wall is wound
\n                        of exit.”\n<\/p><\/blockquote>\n<\/blockquote>\n
            The cause of death was due to fire arm injury.\n<\/p><\/blockquote>\n
The time as suggested by the doctor is identical as the time<\/p>\n
given by the informant so death due to use of fire arm at the<\/p>\n
given time has been established.\n<\/p>\n
            Subsequent to the filing of the appeal a plea<\/p>\n
was taken by the appellant that wrong judgment has been<\/p>\n
passed because on the date of occurrence the appellant was
\n                   5<\/span><\/p>\n
a juvenile.    The claim of juvenility was taken by the<\/p>\n
appellant through I.A. No. 1298 of 2010 in which it was<\/p>\n
stated that on the date of occurrence, i.e., on 16th April,<\/p>\n
2010, his age was assessed to be twenty years. The date of<\/p>\n
occurrence being 06.12.2007 so that he was below eighteen<\/p>\n
years on the date of occurrence, which was recorded in the<\/p>\n
register of Indradeo Sanskrit Prathmik Sah Uchch School,<\/p>\n
Saran.   This Court on 15.12.2010 directed the Juvenile<\/p>\n
Justice Board, Saran, to consider the plea of juvenility of<\/p>\n
the appellant and a report was called for.<\/p>\n
              The called for report     has been received,<\/p>\n
according to which, the appellant was 16 years 2 months<\/p>\n
and 27 days on the date of occurrence and he was declared<\/p>\n
a juvenile by order, dated 14.02.2011 in J.E. No. 156 of<\/p>\n
2011 by Juvenile Justice Board.\n<\/p>\n
              Subsequent to receipt of the enquiry report of<\/p>\n
the Juvenile Justice Board the learned lawyer for the<\/p>\n
appellant has taken plea that he is not challenging the<\/p>\n
conviction, but, he is challenging the sentence. Reliance<\/p>\n
has been placed on several decisions of the Apex Court.<\/p>\n
One of the decisions reported in (2010) 6 S.C.C., 669<\/p>\n
(Mohan Mali & Anr. Vrs. State of Madhya Pradesh),
\n                  6<\/span><\/p>\n
the Apex Court has allowed the appeal and the accused was<\/p>\n
directed to be released forthwith.      In another judgment<\/p>\n
reported in (2010) 5 S.C.C., 344 (Dharambir Vrs. State<\/p>\n
(N.C.T. of Delhi) and Anr.) the Apex Court sustained the<\/p>\n
conviction and quashed the sentence. The learned lawyer<\/p>\n
of the appellant has submitted that he is not challenging the<\/p>\n
conviction and he prays that conviction may be sustained<\/p>\n
and sentence be quashed.\n<\/p>\n
            On merit, with regard to period spent by the<\/p>\n
appellant it has been submitted that he has remained in<\/p>\n
custody since 21.01.2008 and as he has become major due<\/p>\n
to efflux of time, now, he can not be sent to Juvenile Home<\/p>\n
and so his case is on the identical footing as that of the case<\/p>\n
reported in (2010) 5 S.C.C. 334 (supra). In another case<\/p>\n
reported in A.I.R. 1994 S.C., 104 (Pradeep Kumar Vrs.<\/p>\n
State of U.P.), the accused has attained majority during<\/p>\n
pendency of the case and so direction was given to release<\/p>\n
the accused forthwith while conviction was sustained.<\/p>\n
The appellant has already undergone the maximum<\/p>\n
sentence which could be awarded by the Juvenile Justice<\/p>\n
Board. Now no useful purpose is going to be served by<\/p>\n
keeping the appeal pending and if the appeal will be kept
\n                         7<\/span><\/p>\n
       pending the ultimate result would be that the appeal would<\/p>\n
       have be disposed off in terms of the judgment reported by<\/p>\n
       the Apex Court. The legal position will be same.<\/p>\n
                   Considering the submission that the conviction<\/p>\n
       is not challenged, in our view, the order of conviction is<\/p>\n
       sustained and sentence is set aside.\n<\/p>\n
                   With the aforesaid observations and directions<\/p>\n
       this appeal is disposed off.\n<\/p>\n
                   Let the order of release of the appellant, Pankaj<\/p>\n
       Kumar Singh, in connection with S.T. No. 24 of 2009,<\/p>\n
       pending in the Court of Sri Gangotri Ram Tripathi,<\/p>\n
       Additional Sessions Judge, XI, Saran at Chapra, be<\/p>\n
       transmitted forthwith.\n<\/p>\n<\/p>\n
