A Pasayat<\/div>\n<div class=\"doc_bench\">Bench: Dr. Arijit Pasayat, Tarun Chatterjee, Lokeshwar Singh Panta<\/div>\n<pre>           CASE NO.:\nAppeal (civil)  5543 of 2007\n\nPETITIONER:\nDevisingh Meena\n\nRESPONDENT:\nUnion of India\n\nDATE OF JUDGMENT: 30\/11\/2007\n\nBENCH:\nDr. ARIJIT PASAYAT &amp; TARUN CHATTERJEE &amp; LOKESHWAR SINGH PANTA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>CIVIL APPEAL NO.  5543 OF 2007<br \/>\n(Arising out of SLP (C) No. 10899 of 2005)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the judgment of a Division<br \/>\nBench of the Gujarat High Court dismissing the writ petition<br \/>\nfiled by the appellant. His claim relates to the post of Senior<br \/>\nAdministrative Grade. He filed OA 245 of 2001 before the<br \/>\nCentral Administrative Tribunal, Ahmedabad Bench (for short<br \/>\nthe &#8216;Tribunal&#8217;).  Before that he had moved OA 8639 of 1997<br \/>\nmaking the grievance that he was not granted the post of Chief<br \/>\nCommercial Manager, Senior Administrative Grade from 1995.<br \/>\nHis stand was that the Minister of Railways had approved his<br \/>\npromotion in the said grade, but the same was not given effect<br \/>\nto by the respondents.  OA was decided on merits by order<br \/>\ndated 15.1.1999. While dismissing the OA, Tribunal had<br \/>\nobserved that the applicant was not entitled for promotion to<br \/>\nthe post of Chief Commercial Manager in the grade w.e.f.<br \/>\n1.1.1995. The appellant had preferred Special Civil Application<br \/>\nNo.10899 of 2000 before the Gujarat High Court and while<br \/>\ndismissing the same, learned Single Judge had directed the<br \/>\nrespondents to decide the pending representation of the<br \/>\napplicant for his promotion in the light of existing rules and<br \/>\nregulations.\n<\/p>\n<p>3.\tSubsequently, Misc. application no.132 of 2001 was<br \/>\nmoved by the appellant in the said Special Civil Application<br \/>\nwhich was also rejected by the Division Bench on 7.3.2001 in<br \/>\nview of the appellant making a statement that he would<br \/>\nproceed before the appropriate forum in respect of the<br \/>\nchallenge.  A speaking order was passed by the competent<br \/>\nauthority on the representation. Therefore, OA No.245 of<br \/>\n2001 was filed.  Subsequently, prayer in the OA was for<br \/>\nsetting aside the order dated 2.2.2001 passed by the<br \/>\nMember, Railway Board and for direction to the Railways<br \/>\nauthorities to consider his case for promotion w.e.f. 1996.\n<\/p>\n<p>4.\tIt is to be noted that the representation was rejected on<br \/>\nthe ground that though the Minister had initially approved<br \/>\nhis promotion to the Senior Administrative Grade,<br \/>\nsubsequently, by order dated 26.4.1997 he concurred with<br \/>\nnon-inclusion of his name in the panel. He was not<br \/>\nconsidered for promotion. Before the Tribunal stand of the<br \/>\nrespondent was that merely because the Minister had earlier<br \/>\nrecommended for inclusion of appellant&#8217;s name in the Senior<br \/>\nAdministrative Grade at an earlier stage, that did not confer<br \/>\nany right to get promotion particularly when the same<br \/>\nMinister had subsequently approved the exclusion of his<br \/>\nname.\n<\/p>\n<p>5.\tThe stand of the appellant in support of the appeal is<br \/>\nthat once the Minister had approved inclusion of his name,<br \/>\nthere was no question of his subsequently disapproving the<br \/>\ninclusion merely because it was brought to his notice that<br \/>\ninclusion of his name was impermissible.\n<\/p>\n<p>6.\tLearned counsel for the respondent submitted that the<br \/>\nDepartmental Promotion Committee ((in short &#8216;DPC&#8217;) did not<br \/>\nrecommend appellant&#8217;s name. On his representation, the<br \/>\nMinister directed his empanelment. Subsequently, when<br \/>\nmaterials were placed before the Minister, he directed that<br \/>\nthere was no scope for empanelment of appellant.\n<\/p>\n<p>7.\tAt this juncture it is necessary to note that there was no<br \/>\nchallenge to the Minister&#8217;s subsequent order. From the<br \/>\nrecords it is revealed that in the order of 1996, when DPC<br \/>\nhad referred the panel to the Minister for his approval, the<br \/>\nname of the appellant was not included in the list. The<br \/>\nMinister while approving the panel included the name of the<br \/>\nappellant and then approved the panel. Subsequently, the<br \/>\nMember, Special Railway Board, who was one of the<br \/>\nmembers of the DPC, advised the Secretary, Railway Board,<br \/>\nto place the matter before DPC for re-consideration in view of<br \/>\nthe observations made by the Minister.\n<\/p>\n<p>8.\tThereafter, DPC put up a detailed note indicating the<br \/>\nreasons as to why the name of the appellant can not be<br \/>\nincluded for promotion to Senior Administrative Grade. The<br \/>\nMinister accepted the reasons given by the DPC for non-<br \/>\ninclusion and further approved the panel which did not<br \/>\nfigure appellant&#8217;s name.\n<\/p>\n<p>9.\tIt is not in dispute as per applicable provisions, the<br \/>\npromotions have been granted.  Appellant&#8217;s name was not<br \/>\nrecommended by the DPC and, therefore, he could not have<br \/>\nbeen appointed.\n<\/p>\n<p>10.\tAppellant&#8217;s stand is that once the Minister had directed<br \/>\ninclusion of his name, there was no scope for making a<br \/>\ndeparture from the view.  This stand is clearly unsustainable.<br \/>\nAs has been rightly contended by the learned counsel for the<br \/>\nrespondent, at the first stage though the Minister had<br \/>\ndirected inclusion of appellant&#8217;s name, subsequently when<br \/>\nrelevant material was placed before him, he took a view<br \/>\ndifferent from what he had taken earlier.  As noted above,<br \/>\nthere was no challenge to the Minister&#8217;s order disapproving<br \/>\nthe case of the appellant.\n<\/p>\n<p>11.\tThat being so, there is no scope for interference with the<br \/>\norders passed by the Tribunal and the High Court.  The<br \/>\nappeal is without merit and is dismissed.
