Justice R.BASANT\n\n Dated :21\/02\/2007\n\n O R D E R\n                                R.BASANT, J\n\n                             ----------------------\n\n                          Tr.P.(Crl).No.32 of 2007\n\n                       ----------------------------------------\n\n               Dated this the 21st day of February  2007\n\n\n\n\n                                  O R D E R\n<\/pre>\n<p>      The   petitioner   is   the   accused   in   two   prosecutions   both<\/p>\n<p>under Section    138 of the Negotiable  Instruments Act and both<\/p>\n<p>initiated   by   the   same   complainant.     Both   those   cases   were<\/p>\n<p>initiated as early as in 2003.   They have now reached the stage<\/p>\n<p>of defence evidence.  Signatures in the cheques are not disputed.\n<\/p>\n<p>The contention is that the complainant had come into possession<\/p>\n<p>of   the   blank   cheques   and   is   attempting   to   misuse   those   signed<\/p>\n<p>blank   cheques.     The   complainant   was   cross-examined.     At   the<\/p>\n<p>stage of defence evidence, the petitioner\/accused cited the wife<\/p>\n<p>of the complainant as defence witness.   That witness   has been<\/p>\n<p>examined also.   The petitioner went before the learned Sessions<\/p>\n<p>Judge   with   the   grievance   that   the   learned   Magistrate   is<\/p>\n<p>entertaining a prejudice and therefore he does not expect justice<\/p>\n<p>at the hands of the learned Magistrate.\n<\/p>\n<p>      2.     Why   did   he   entertain   such   an   apprehension?\n<\/p>\n<p>Sweeping,   general   and   vague   allegation   was   raised   that   the<\/p>\n<p>learned Magistrate had not permitted some questions to be put<\/p>\n<p><span class=\"hidden_text\">Tr.P.(Crl).No.32\/07                    2<\/span><\/p>\n<p>to   the   defence   witness.     The   learned   Sessions   Judge   pointedly<\/p>\n<p>considered that aspect and stated that the vague, sweeping and<\/p>\n<p>general allegations raised are not sufficient to justify the prayer<\/p>\n<p>for transfer of the cases.  Accordingly, the learned Magistrate, by<\/p>\n<p>the order produced as Annexure-II dismissed the application for<\/p>\n<p>transfer.     Dissatisfied   with   the   said   order,   the   petitioner   has<\/p>\n<p>come   before   this   court.     Even   now,   no   specific   and   precise<\/p>\n<p>allegation is raised as to what question had not been permitted<\/p>\n<p>by the  learned  Magistrate  and how  refusal  to permit such non-\n<\/p>\n<p>specified questions can be reckoned by this court as indicative of<\/p>\n<p>the   prejudice   entertained   by   the   learned   Magistrate.     I   am,   in<\/p>\n<p>these circumstances, satisfied that the prayer for transfer made<\/p>\n<p>before this court is also without any substance.   The said prayer<\/p>\n<p>cannot be accepted.\n<\/p>\n<p>       3.     The learned counsel for the petitioner submits that if<\/p>\n<p>a   further   opportunity   is   given   and   some   time   were   granted,   it<\/p>\n<p>shall   be   possible   for   the   petitioner   to   narrate   the   specific<\/p>\n<p>questions   which   were   disallowed   by   the   learned   Magistrate.     I<\/p>\n<p>am not persuaded to grant any further time.   This is so because<\/p>\n<p>in   Annexure-II   order,   for   the   very   same   reason,   the   learned<\/p>\n<p><span class=\"hidden_text\">Tr.P.(Crl).No.32\/07                   3<\/span><\/p>\n<p>Sessions   Judge   had   refused   the   prayer   for   transfer.     Non-\n<\/p>\n<p>specification of such questions in this transfer petition also must,<\/p>\n<p>in these circumstances,  be held to be crucial and vital.  I am not,<\/p>\n<p>in   these   circumstances,   persuaded   to   accept   the   impassionate<\/p>\n<p>request made by the learned counsel for the petitioner  for some<\/p>\n<p>further time.\n<\/p>\n<p>       4.
