Jyoti Devi wife of Sudhanshu Dubey @ Guddu Dubey\n                     Daughter of Sri Rajan Pandey.\n                  Resident of village-Mukundpur, P.S.-Ekma, District-Saran at\n                  Chapra (Bihar).\n                                                          Opposite Parties.\n                                              -----------\n<\/pre>\n<p>2.   01.08.2011                Heard      learned   counsel     for   the<\/p>\n<p>                     petitioner     and   learned   Additional    Public<\/p>\n<p>                     Prosecutor for the State.\n<\/p>\n<p>                              The     petitioner    apprehending      his<\/p>\n<p>                     arrest in connection with Complaint Case no.<\/p>\n<p>                     3959 of 2007(Trial no. 2070 of 2010) for the<\/p>\n<p>                     offence under Section 498 (A)\/34 of the<\/p>\n<p>                     Indian Penal Code, pending in the Court of<\/p>\n<p>                     learned Sub-Divisional Judicial Magistrate,<\/p>\n<p>                     Saran at Chapra.\n<\/p>\n<p>                                  Petitioner is named accused in this<\/p>\n<p>                     case being husband of the complainant with<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>allegation of demand of dowry. Submission<\/p>\n<p>is that the petitioner has already obtained<\/p>\n<p>and decree under Section 9 of the Hindu<\/p>\n<p>Marriage Act from the Principal Judge Family<\/p>\n<p>Court, Jamshedpur in Matrimonial Case no.<\/p>\n<p>103 of 2008 but there is no response from<\/p>\n<p>the complainant. Further submission is that<\/p>\n<p>still   petitioner   intends   to   resume   and<\/p>\n<p>demand of matrimonial relationship with the<\/p>\n<p>complainant to whom he has not paid even a<\/p>\n<p>single paisa by way of interim maintenance<\/p>\n<p>in absence of any order of the Court.<\/p>\n<p>considering      the    aforesaid    facts   and<\/p>\n<p>circumstances and petitioner being employed<\/p>\n<p>at Jamshedpur in a private firm in the event<\/p>\n<p>of his filing application before the Court<\/p>\n<p>below stating his such intentions and further<\/p>\n<p>offer to pay a sum of Rs. 1,000\/- per month<\/p>\n<p>by interim maintenance to subject to any<\/p>\n<p>order of the competent Court on the point.<\/p>\n<p>          Considering      the      facts    and<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>          circumstances of the case, in the event of his<\/p>\n<p>          arrest or surrender within a period of four<\/p>\n<p>          weeks,   let   the       petitioner,   namely,     be<\/p>\n<p>          enlarged on bail furnishing bail bond of Rs.<\/p>\n<p>          10,000\/-     (ten       thousand   only)   with   two<\/p>\n<p>          sureties of the like amount each to the<\/p>\n<p>          satisfaction of Chief Judicial Magistrate, in<\/p>\n<p>          connection with the above referred case<\/p>\n<p>          subject to condition as laid down under<\/p>\n<p>          Section 438(2) of the Code of Criminal<\/p>\n<p>          Procedure, and additional condition to attend<\/p>\n<p>          the court regularly at least for two years or<\/p>\n<p>          till disposal of the case, whichever is earlier<\/p>\n<p>          and in the event of failure of two consecutive<\/p>\n<p>          dates, without reasonable explanation, the<\/p>\n<p>          privilege granted shall be deemed to be<\/p>\n<p>          cancelled.\n<\/p>\n<p>\nKamlesh                                  (Akhilesh Chandra, J.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sudhanshu Dubey @ Guddu Dubey @ &#8230; vs The State Of Bihar &amp; Anr. on 1 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
