Dabhi, learned APP appears and waives service of notice of  Rule<br \/>\non behalf of  the respondent &#8211; State of Gujarat.\n<\/p>\n<p>3\tHaving<br \/>\nregard to the facts of the case,  the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p><span class=\"hidden_text\">4\t<\/span><\/p>\n<p>The applicant &#8211; convict prisoner, has filed this application<br \/>\nthrough his brother &#8211; Lakhmanbhai Bhikhabhai Dayama,  who vide<br \/>\njudgment and order dated  22.01.2010,  rendered in Sessions Case No.<br \/>\n238 of 2009, by the Additional Sessions Judge, Ahmedabad, has been<br \/>\nconvicted for the offence punishable under Sections 302 etc, of the<br \/>\nIndian Penal Code and sentenced to imprisonment for life, praying  to<br \/>\nenlarge him  on temporary bail, for a period of  one month,  to<br \/>\nenable him to perform  the marriage of his daughter, which is<br \/>\nscheduled on 23.01.2011, arranged by Ahmedabad District Karadia<br \/>\nRajput Samaj.\n<\/p>\n<p>5\tWe<br \/>\nhave considered the submissions advanced by Mr. D.D. Nanavati,<br \/>\nlearned Advocate for the applicant  and Mr. L.B. Dabhi, learned APP<br \/>\nfor the respondent &#8211; State of Gujarat.  We have also perused<br \/>\nthe averments made in the application and also documents annexed<br \/>\ntherewith.  We have also gone through the jail remarks sheet<br \/>\nsubmitted by learned APP during the course of  submission.\n<\/p>\n<p>6\tUpon<br \/>\nperusal  of the jail remarks sheet, we have noticed  that the<br \/>\napplicant convict &#8211; prisoner has undergone  total period of<br \/>\nimprisonment of  2 years, 3 months and 25 days.  During he said<br \/>\nperiod,  he was not  released on  temporary bail, however, he has<br \/>\nenjoyed one furlough leave for  15 days to attend  the obsequious<br \/>\nceremony of his father.  He has surrendered  in time.  There is no<br \/>\njail punishment and his  jail  conduct is good.  Besides this, the<br \/>\nground stated by applicant convict &#8211; prisoner appears to be<br \/>\ngenuine. In view of the aforesaid, if the applicant is released on<br \/>\ntemporary bail for a period of 15 days from the date of his actual<br \/>\nrelease, the same would meet the ends of justice.\n<\/p>\n<p>7\tFor<br \/>\nthe foregoing reasons,  the Application succeeds in part.<br \/>\nAccordingly,  it is partly allowed. The applicant- convict prisoner &#8211;<br \/>\nBHAGWANBHAI<br \/>\nBHIKHABHAI DAYMA is<br \/>\nordered to be released on  temporary bail  for a period of 15 days<br \/>\nfrom the date of  his   actual  release on executing a personal bond<br \/>\nof Rs. 5,000\/- before the Jail Authority on usual terms and<br \/>\nconditions.  The applicant shall  surrender to<br \/>\nthe jail authority  on completion of  15 days  from the date of his<br \/>\nrelease  without fail.
