Advocate\n\nHon'ble Surendra Singh,J.\n<\/pre>\n<p>Counter affidavit filed today by the learned A.G.A. is taken on record.\n<\/p>\n<p>Heard learned counsel for the applicant and learned A.G.A. and<br \/>\nperused the material placed on record.\n<\/p>\n<p>Applicant-Sonu @ Arunendra Tiwari seeks bail in Case Crime No. 35<br \/>\nof 2008 under Sections 364-A, 120-B I.P.C. and Sections 10\/12\/143 of<br \/>\nDacoity Affected Area Act, Police Station Kotwali Karvi, District<br \/>\nChitrakoot.\n<\/p>\n<p>Submissions have been made on behalf of the applicant that the<br \/>\napplicant is not named in the F.I.R. His complicity as a participant in<br \/>\nthe crime has surfaced after his arrest along with alleged kidnapee,<br \/>\nRam Yash Ojha during police encounter on 7.1.2008 at about 4.35<br \/>\nA.M. at Bedi Pulia which is within the territorial jurisdiction of Police<br \/>\nStation Karvi, District Chitrakoot. Learned counsel further submits that<br \/>\nthe incident is alleged to have taken place on 6.1.2008 at about 8.00<br \/>\nP.M. and the F.I.R. was registered on the same day at about 10.00<br \/>\nP.M. and the alleged kidnapee was recovered in the next morning i.e.<br \/>\njust after 8 hours of the incident near the house of co-accused, Uma<br \/>\nKant. He further submits that had the applicant kidnapped the father of<br \/>\nthe informant, he would not have remained near the place of the<br \/>\nincident. He next argued that co-accused, Uma Kant as well as<br \/>\nJitendra, the owner of the motorcycle, have been granted bail by the<br \/>\ncourt concerned. He has further submitted that the applicant is in jail<br \/>\nsince 7.1.2008 and the trial has not commenced which is likely to take<br \/>\nsometime to conclude. He has further submitted that the applicant has<br \/>\ngot no criminal history to his credit, thus he deserves to be released on<br \/>\nbail.\n<\/p>\n<p> The bail is, however, opposed by the learned A.G.A.<br \/>\nThe points pertaining to nature of accusation, severity of punishment,<br \/>\nreasonable apprehension of tampering the witnesses, prima facie,<br \/>\nsatisfaction regarding proposed evidence and genuineness of the<br \/>\nprosecution case were duly considered.\n<\/p>\n<p>Considering totality of circumstances of the case, I consider it a fit<br \/>\ncase to enlarge the applicant on bail.\n<\/p>\n<p>Without expressing any opinion on the merits of the case, let the<br \/>\napplicant-Sonu @ Arunendra Tiwari involved in aforesaid crime be<br \/>\nreleased on bail on his furnishing a personal bond of Rs. 50,000\/- and<br \/>\ntwo sureties each in the like amount to the satisfaction of the court<br \/>\nconcerned with the following conditions that;\n<\/p>\n<blockquote><p>    1. The applicant shall not tamper with the prosecution evidence<br \/>\n      by intimidating the witnesses.\n<\/p><\/blockquote>\n<blockquote><p>    2. He shall cooperate with the investigation and speedy trial.\n<\/p><\/blockquote>\n<blockquote><p>    3.
