The<br \/>\nEducation Department had taken decision to prefer the appeals and<br \/>\ninstructed the appellant to prefer the appeals by letter dated<br \/>\n4.9.2009 and thereafter immediately appeals were filed on 18.9.2009.<br \/>\nThe applications were sought to be opposed by filing reply affidavit<br \/>\nof Ms.M.B.Joshi, stating, in substance, that the applicants were<br \/>\nalthroughout aware of the impugned order and had, in fact,<br \/>\nparticipated in the proceedings of the appeals preferred from the<br \/>\nsame order by the opponents.\n<\/p>\n<p>2.\tHowever,<br \/>\nknowledge of the proceedings or further proceedings pursuant to the<br \/>\nimpugned order cannot, by itself, be a ground not to condone delay.<br \/>\nIt was submitted by learned counsel, Mr.Mankad that the applicants<br \/>\nhad no alternative but to seek necessary instructions and approval<br \/>\nfrom the State Government which, in the nature of things, take a<br \/>\nlittle longer time and the appeal ought not to be thrown out only on<br \/>\nthe ground of delay.  He relied upon recent decision of the Supreme<br \/>\nCourt in  <a href=\"\/doc\/1962587\/\">State (NCT of Delhi) v.
